Chapter 9 - Mercer Peak

Mercer Peak Partners was not a scam.
That surprised me.
Ethan Shaw and Mason Rhodes were real investment professionals.
They had identified a distressed cybersecurity software company with potential.
They formed a small acquisition vehicle.
Julian had committed $480,000.
He had paid $120,000 deposit.
Final $360,000 due Friday after our wedding.
We attack Tuesday.
He was short.
His personal accounts showed about $95,000 liquid.
Margin capacity maybe.
Margaret willing $100,000 more.
Still short.
Hence line credit.
Could he simply lose deposit?
Yes.
He chose fraud instead.
Ethan Shaw testified later:
“Julian told us his marriage would free capital.”
“What did you think?”
“That Ava planned to invest.”
“Did he say?”
“Yes.”
No.
Then pitch deck to software owners listed:
Mercer Peak principals supported by family capital relationships exceeding $75m.
No name Halcyon but implied.
The owners liked strong backing.
Was that securities fraud? Private deal, maybe misrepresentation. Federal/state securities investigators reviewed but no separate charge because no investor funds were raised based solely and deal never closed. Could be evidence of motive.
Then after my assault, Mercer Peak collapsed because Julian failed capital call.
Ethan and Mason covered? They found replacement investor, reduced Julian to 0, forfeited deposit under agreement.
Julian lost $120k.
He blamed me.
Messages from jail/bond? After release, he texted partners:
Ava sabotaged funding.
Ethan:
You told us capital committed.
Julian:
It was.
Ethan:
Not from what we can see.
Then Julian:
She changed her mind.
False.
Ethan preserved.
Then Margaret paid legal.
Her home equity.
She had enough but not endless.
The financial crimes she attempted were not born from poverty.
Pride.
Control.
Fear Julian would look unsuccessful.
Then family culture.
Robert Mercer, deceased father, had apparently been harsh about success.
Julian told me once:
“Dad called any salaried job working for someone else pathetic.”
Julian went into finance but remained employee at private equity firm? What was his job? Maybe corporate development director earning $300k. He wanted own fund to prove.
Margaret repeated Robert’s standards after death.
This shaped but did not excuse.
Then my father and I talked.
“Granddad pressured you?”
“Yes.”
“How?”
“If I didn’t work at Bennett, he thought I wasted life.”
“But you went asset management.”
“He hated first five years.”
“Why?”
“Not family company.”
“How change?”
“I succeeded.”
“So he respected outcome.”
“Yes.”
“Did that make you feel you had to?”
Dad looked.
“Yes.”
We all inherit pressure.
Difference is choices.
Then Halcyon itself became symbol.
Granddad built to prevent descendants squandering.
Ironically attracted Julian.
I asked corporate trustee whether I could relinquish? Not necessary. I just hated trust.
Elaine Foster said:
“Do not make permanent financial decisions because someone abused you.”
Same as not letting abuser determine.
I kept.
Then distribution.
I requested lower distribution that year because salary enough.
No need hide wealth.
Then family office tightened fraud controls for all beneficiaries after incident.
Dual verification.
No spouse authorization without live notarization/ video.
Independent counsel callback.
My cousins complained about inconvenience.
I said:
“You’re welcome.”
They laughed.
Then one cousin admitted fiancé had asked weird questions too.
We all became more careful.
May you like
No paranoia.
Transparency.
