Chapter 12 - Margaret’s Sentence

Margaret’s sentencing came first.

She wore gray.

No cream silk.

No jewelry except wedding ring from deceased husband.

She looked smaller.

Prosecutor recommended 16 months.

Defense requested probation/home confinement.

Factors:

No prior criminal history.

No monetary loss.

Early plea.

Cooperation.

But deliberate forgery.

Abuse of notary authority.

Scheme targeted daughter-in-law.

Submitted after son arrested, demonstrating persistence.

Judge imposed 12 months and one day? In state, maybe not. Let's say 14 months state custody, 2 years supervised release/probation, permanent revocation of notary commission, financial restitution for investigation fees? Victim restitution maybe my legal credit protection costs around $18k, but civil separate. Could order $9,600 for fraud mitigation. Let's keep.

She also faced no prison for calling me names.

Her sentence was paperwork crimes.

Before sentence, Margaret spoke.

“I believed marriage made Ava’s insistence on separate money selfish.”

Then:

“I believed my son was entitled to know and manage what she had.”

Then:

“I knew she did not sign.”

Then:

“I did it anyway.”

No excuses.

Then me.

I submitted written, did not attend.

My statement:

“The part that frightened me most was not the amount. It was how ordinary my private information became in your hands. My driver’s license, signature, trust documents, work life, home. You treated marriage to your son as permission to use all of me.”

That was it.

Then Margaret sent apology through attorney.

I did not read immediately.

Months later.

Ava,

I thought independence was arrogance because I spent my marriage making dependence look like virtue.

Interesting.

Then:

I taught Julian that being husband meant being obeyed.

Then:

He chose violence. I did not tell him to strike you. But I taught him to interpret your no as humiliation.

That distinction mattered.

Then:

I forged your name. I am sorry.

I did not reply.

Then Julian’s sentencing.

He was already serving assault sentence.

Financial judge considered overlap and consecutive/concurrent.

Loss no actual Halcyon money, but attempted line credit $450k and intended control. Sentencing based attempted loss maybe credit amount + scheme.

He also destroyed trust, employment sabotage.

He was 34? User says 30s. Let's say 33.

No prior record.

Good education.

High income.

Then he finally admitted?

Before sentencing he said:

“I wanted Ava’s money to solve a problem I created.”

That was true.

Then:

“I thought marriage meant I could make financial decisions for both of us.”

Then:

“When she said no, I became violent.”

First real.

“I was wrong.”

Then:

“I did not marry her only for money.”

That line surprised me.

“I loved her.”

Could both be true.

Then:

“I also thought loving her entitled me to what she had.”

There.

Judge sentenced 4 years 8 months for financial felonies, with 12 months concurrent to remaining assault sentence and rest consecutive? Effective total maybe around 5 years 4 months from initial custody. Let's calculate: Assault 20m. Financial 56m, 12 concurrent => total 64m ~5y4. Good.

Restitution:

My fraud mitigation/legal document replacement costs $27,400.

Northshore no loss.

Halcyon no loss.

Mercer Peak not victim from fraud? Deposit loss contractual, not restitution to him obviously.

He paid forfeiture? Fraud proceeds none.

Civil divorce separate.

No millions.

Then Margaret served 11 months with credits.

May you like

Julian longer.

Then divorce finalized while he incarcerated.
