Chapter 12 - The First Hearing

The criminal preliminary hearing drew press.
I hated cameras outside courthouse.
“Former Wall Street prodigy.”
“Hart heiress.”
“Blackwood scandal.”
Every identity I avoided became headline.
Damian wanted communications team.
“No.”
“Evie.”
“No reputation campaign.”
“At least statement.”
“My lawyer can say we respect process and prioritize Penny.”
“That’s a statement.”
“Fine.”
We issued exactly that.
No details.
Inside, prosecutors presented enough for case to proceed.
Elaine testified.
Thomas Reed testified.
Hospital physician authenticated injuries.
Officer Reynolds testified about basement and locked door.
Defense argued:
The belt strikes were intended to frighten, not injure.
Basement was temporary cooling off.
Service exit meant not truly confined.
Penny entered voluntarily.
I nearly laughed.
Prosecutor responded:
Julian locked main basement door from outside.
He controlled ordinary exit.
Victim’s knowledge of hidden service passage does not make confinement consensual.
Judge found probable cause.
Case moved.
Not conviction.
Then custody hearing.
Separate.
Julian’s lawyer requested therapeutic contact.
Penny’s therapist now supported brief video contact if Penny chose.
Penny said:
“No.”
Court did not force immediately.
Three months later:
“Maybe.”
We prepared.
First video lasted seven minutes.
Julian appeared from temporary apartment.
No tuxedo.
No arrogance.
“Hi, Penny.”
She stared.
“Hi.”
“I miss you.”
Therapist interrupted:
“Julian, focus on Penny’s comfort, not emotional obligation.”
He nodded.
“Okay.”
Then:
“I’m sorry you were scared.”
Penny’s face hardened.
“You locked door.”
“Yes.”
“Why?”
“I was angry.”
“That’s not reason.”
He looked stunned.
Seven year old.
Correct.
“I made a terrible choice.”
“You hit Mom.”
“Yes.”
“Was Vanessa lying?”
His lawyer had likely warned not discuss case.
He said:
“I can’t talk about that.”
Penny looked at therapist.
“I’m done.”
Call ended.
I hugged her only when she asked.
She said:
“He didn’t say sorry right.”
“What would be right?”
“I’m sorry I locked you.”
Specific.
Children understand accountability.
The next call, Julian did better.
“I’m sorry I locked you in basement.”
Penny nodded.
No forgiveness.
May you like
Progress maybe.
Then Vanessa entered formal plea.
