Chapter 14 - Isabella’s Last Witness

Gavin Rourke was not the only surviving witness.

A woman named Caroline Webb contacted prosecutors after seeing coverage.

Seventy two.

Former administrative assistant to Malcolm Thorne.

She had never spoken publicly.

Why now?

“My husband died last year. I’m tired of protecting a man he hated.”

She possessed a diary.

No secret recording.

Personal notes.

On the night of warehouse fire:

M.T. called L.M. twice. Angry. Said Rourke failed to get documents before woman arrived. Ordered ‘clean it out.’ Fire reported 42 minutes later.

Not exact criminal confession.

Corroboration.

She also had a photocopy of a fax Malcolm ordered destroyed.

No files survive tonight.

The phrase was damning.

Still, did Malcolm know Isabella was inside?

Rourke said yes after his men reported seeing her.

Phone timing supported a call before fire.

Prosecutors strengthened felony murder/arson conspiracy theory.

Malcolm’s plea negotiations collapsed.

He chose trial.

Bianca agreed to testify.

That surprised me.

Against her father.

Dante said:

“Families finally eating themselves.”

I looked at him.

“That isn’t healthy language.”

“You’re right.”

He kissed Nora’s forehead.

“Families finally experiencing evidentiary consequences.”

I laughed so hard I woke the baby.

Trial began eight months after cemetery.

I attended only two days.

First:

Bianca’s testimony.

She admitted Malcolm directed search for bracelet and Eleanor materials.

She admitted he feared old evidence.

She described call after cemetery where he said:

“You should have taken it before Moretti arrived.”

Second:

Caroline Webb.

She described Malcolm’s words from night Isabella died.

Dante attended more.

He testified about journal chain.

Careful.

No speculation.

Defense argued Lorenzo Moretti was true mastermind and Malcolm merely cleaned up a dangerous situation after Moretti initiated confrontation.

That was partly plausible.

Dante’s own historical report supported Lorenzo’s culpability.

The prosecution did not hide it.

That strengthened credibility.

Then defense asked Dante:

“You have every reason to blame Senator Thorne to protect your father’s legacy, don’t you?”

Dante answered:

“My father’s legacy is already damaged by the truth. I am not here to protect it.”

The courtroom went still.

Defense moved on.

Nora was nine months old when verdict came.

Malcolm Thorne was acquitted of the most serious intentional murder theory.

Convicted on conspiracy related to destructive fire causing death? We need careful. Let's say convicted of felony murder or arson? Jury could convict conspiracy to commit arson and felony murder if evidence sufficient. But if acquitted intentional murder, felony murder can still be based on arson. Let's make:

convicted of conspiracy to commit arson, felony murder stemming from death during arson, obstruction of justice, and fraud counts.

This is serious. Need maybe in Virginia felony murder includes accidental killing in commission of felony. Fine.

acquitted of premeditated murder.

This nuance good.

Rourke received reduced sentence for cooperation.

Malcolm sentenced to decades, effectively likely remainder of life given age 68? We can set 69 and sentence 24 years. Not guarantee die in prison but substantial.

Dante did not celebrate.

Neither did I.

We visited Isabella’s grave.

He stood.

“I thought this would feel better.”

“It isn’t supposed to.”

“What is it supposed to feel?”

“Finished.”

Not yet fully.

Because one question remained.

Why did Eleanor never tell Dante herself after Lorenzo died twelve years earlier?

The answer was in one final page investigators had overlooked.
