Chapter 14 - The Custody Trial

Judge Carver spent two days hearing evidence.

Dr. Carter.

Grace.

The forensic evaluator.

Financial investigator only where relevant to coercion.

Amanda’s prior testimony admitted by stipulation where allowed.

Ethan.

Me.

Grace testified first.

Ethan’s attorney brought up her old theft accusation.

“Were you once investigated for stealing cash?”

“Yes.”

“Were you fired?”

“I resigned after accusation.”

“Was it proven false?”

“Yes. The employer’s son admitted taking it.”

“Did you fall asleep holding Ava?”

“For a few seconds.”

“Could that have been dangerous?”

“Yes.”

“Did Claire fire you?”

“No.”

“Why?”

Grace looked at me.

“Because she addressed what happened instead of pretending it didn’t.”

That was not rehearsed.

I cried.

Then Ethan testified.

“I was terrified Claire would leave and prevent me from seeing Ava.”

“Did she threaten that?”

“No.”

“Why did you draft custody petition?”

“Advice.”

“Why stage bath video?”

He looked down.

“I wanted evidence.”

“Of something that had not happened?”

“Yes.”

“Why?”

“Because I thought Grace was unsafe.”

“Then why not fire her?”

“Claire wouldn’t.”

“Did you ask?”

“No.”

Silence.

That killed the logic.

He continued:

“I was under enormous financial pressure.”

Judge asked:

“Mr. Bennett, what did financial pressure have to do with placing your infant in a bath to create misleading evidence?”

Ethan had no good answer.

Finally:

“I wanted leverage.”

There.

Judge wrote something.

My testimony was simpler.

“I want Ava to know her father if he can be safe.”

Ethan stared at me.

His lawyer looked surprised.

Judge:

“You are not seeking termination of parental rights?”

“No.”

“Why?”

“Because what Ethan did was serious. It does not mean I can decide today that Ava should never know him.”

“Do you trust him?”

“No.”

“Do you believe supervised contact appropriate?”

“Yes.”

That was truth.

Final order:

Sole legal custody to me.

Primary physical custody to me.

Ethan supervised visitation during and after criminal sentence subject to correctional rules and later therapeutic review.

No Amanda contact unless I consent or court modifies.

No unsupervised caregiving delegation to involved parties.

Future step up possible only with evidence of treatment, accountability, and child safety.

No automatic restoration.

Ethan’s parental rights remained.

Legal father.

Child support calculated.

He cried.

So did I.

Not victory.

Loss arranged safely.

After court, Ethan approached within allowed distance with lawyers present.

“Why didn’t you ask them to erase me?”

I looked at him.

“Because I’m not you.”

He flinched.

Maybe cruel.
