Chapter 15 - The Divorce

Chloe filed for divorce two weeks after rescue.

No children.

No custody.

That simplified.

The marriage lasted just over two years.

Their condo:

Purchased by Damian before marriage.

Separate property with possible community-equivalent marital claims? Georgia equitable distribution, not community. We are in Atlanta. Need use Georgia law. So marital property division based on equitable principles. Chloe had contributed to mortgage/renovations but title Damian. Her lawyer sought marital share of appreciation based on contributions where appropriate.

Her $140,000 transfer became major issue.

Gift?

Loan?

Equity?

Fraudulently obtained?

Evidence:

Text from Chloe:

I can lend 140 until summer but I need it back for studio taxes and savings.

Damian:

We’ll repay once patio season hits.

That was enough to undermine “gift.”

Not a gift.

A loan.

Damian later texted:

Stop calling it your money. We’re married.

That helped too.

The divorce court eventually treated claim in conjunction with civil recovery rather than awarding restaurant ownership.
