Chapter 11 - Emergency Guardianship

Family court hearing happened six days after rescue.
Lizzy remained hospitalized until day four, then discharged medically.
CPS needed placement.
My parents suspended as guardians.
Ian still legal father but in residential treatment and not ready for immediate full time custody.
He appeared by video.
Judge asked:
“Mr. Hayes, what are you requesting?”
Ian looked wrecked.
“That Lizzy stay with my sister Natalie and her husband Adam until I complete treatment and court says I’m ready.”
“Do you understand that may take time?”
“Yes.”
“Are you voluntarily agreeing?”
“Yes.”
“Are you relinquishing parental rights?”
“No.”
“Do you consent to Natalie making educational and medical decisions temporarily?”
“Yes.”
Then Gloria’s attorney objected to placement with me.
“Ms. Brooks unlawfully entered guardians’ residence and removed child.”
Deputy Mills testified.
Emergency call.
Child trapped.
No guardians present.
Exterior latch.
Law enforcement dispatch underway.
No charges against me for entry.
Judge’s expression made attorney stop pushing.
Temporary kinship placement granted to me and Adam.
Supervised contact with Ian through treatment program.
No contact Gloria or Walt pending investigation.
Lizzy came home with us carrying bear and hospital discharge folder.
Adam had moved his office into basement so she could have room nearest ours.
When she saw bed, she asked:
“Does door lock?”
“From inside if you want.”
She stared.
“Can I leave it open?”

“Yes.”
She slept with door open for eight months.
