Chapter 9 - The Plea Daniel Refused

Daniel went to trial.

Not because evidence weak.

Because he insisted context would vindicate him.

His lawyer’s strategy:

Margaret made impulsive decision.

Daniel restrained Lily to prevent injury.

His recording was to protect himself against Claire’s aggression.

His “shave it” messages were dark humor.

The jury saw full context.

I testified.

Not about Daniel’s soul.

Facts.

He texted me to pick Lily up.

He was already there.

I entered garage.

Saw clippers.

Lily crying.

I knocked clippers away.

Daniel grabbed my hair.

I shoved him.

Cross examination:

“Mrs. Bennett, you tackled Margaret?”

“I pushed her away from Lily and removed clippers.”

“You threw clippers?”

“Yes.”

“You shoved Daniel?”

“Yes.”

“You were angry?”

“Extremely.”

“Would you describe yourself as explosive?”

“No. I would describe my reaction that day as intense.”

No need pretend calm.

The video showed.

Then Daniel’s message:

That’s the point.

The unsent lawyer email:

I expect another incident soon and may have video.

The jury did not need my interpretation.

Daniel testified.

That surprised everyone.

He said he never wanted Lily cut that severely.

Prosecutor asked:

“How much did you want removed?”

His lawyer objected.

Sustained.

Then:

“Did you tell Margaret to shave Lily’s hair?”

“I was joking.”

“Did you drive there after Margaret said Lily was taking too long?”

“Yes.”

“Did you set your phone to record?”

“Yes.”

“Did you hold Lily in chair?”

“To keep her safe.”

“Did you stop Margaret?”

“No.”

“Did Lily ask you to?”

Silence.

“Yes.”

“Did you tell her to stop making it worse?”

“Yes.”

That answer ended him emotionally.

The jury convicted on child endangerment and assault arising from restraint.

Acquitted on one more serious charge requiring a mental state prosecutors could not prove beyond reasonable doubt.

That distinction mattered.

He had done terrible things.

The law still had elements.

Sentencing came later.

Family court suspended supervised visitation during immediate post trial period because Lily became distressed.

Not punishment.

Therapeutic recommendation.

Daniel wrote through app:

May you like

I understand.

First time he did not fight.
