Wire fraud sounded bigger than the actual conduct.
Sarah explained:
“It is not about a wire being special. It is about using electronic communications or payment systems as part of a scheme to obtain money through material misrepresentations.”
The government had to prove intent.
Not just family boundary violation.
Evidence:
False listing.
False owner representations.
Digital signature.
Payment links.
Interstate guests.
Messages acknowledging I did not know and would refuse.
Money distribution.
Strong.
Dad’s defense:
He believed broad family permission and that operating costs/benefits were legitimate.
The forged management agreement was biggest problem.
Keaton’s cooperation got stronger.
He entered plea agreement first.
One count conspiracy to commit wire fraud.
One count wire fraud tied to a specific Virginia renter transaction.
He admitted creating false authorization and booking page.
Government recommended reduced sentence for substantial assistance.
He also agreed restitution and forfeiture of $37,900 personal proceeds plus additional joint restitution.
Dad called him coward.
Keaton did not respond.
Then Elaine.
Her lawyer negotiated.
She admitted scheduling rentals, knowing no permission, knowing forged form existed, receiving funds.
She did not create listing or negotiate most outsider payments.
She pleaded guilty to conspiracy.
Government recommended probation/home detention due age, lesser role, cooperation, no record, and restitution.
Was that fair?
Maybe.
Then Richard remained trial.
He could plead.
Refused.
He told reporter? Lawyer advised no. He posted once:
“This is a family property disagreement being criminalized.”
Judge ordered no prejudicial public statements? Not exactly. His lawyer took down.
Then relatives.
Several testified grand jury.
Liora.
Melissa.
Paul.
Jennifer.
No one hated Dad.
They described.
Richard said he managed.
Arden approved.
Money helps mortgage.
Owner consent shown.
Then my testimony.
I hated courthouse.
No clinical smells.
No familiar machines.
I swore.
Ownership.
No permission.
No money.
Signature fake.
The prosecutor asked:
“Did your father ever ask to rent property to strangers?”
“No.”
“Would you have consented?”
“No.”
Defense:
“Did you say family could enjoy house?”
“Yes.”
“Did you ever charge parents for staying?”
“No.”
“So they had free access?”
“With me, when invited.”
“Did you specifically say they could not use when you absent before discovery?”
“I never gave permission to enter without asking.”
“Did you ever change locks before?”
“No, because I did not know they had key.”
“Did you know relatives stayed Memorial Day?”
“No.”
“After you discovered, did you immediately hire lawyer?”
“Yes.”
“Could you have called father first?”
“I had just found evidence he was secretly using property.”
“Answer yes/no.”
“Yes.”
Defense tried make overreaction.
Then forged consent.
“Did Keaton create?”
“I did not witness.”
“Did Richard?”
“I did not witness.”
Good.
I only knew mine not.
Then Dad’s lawyer asked:
“Do you love father?”
Objection relevance.
Sustained.
Thank God.
Then trial later.
Before that, civil case stayed partly due criminal.
Insurance finally resolved Jennifer.
Because her release with Richard invalid as to me but she did not pursue after insurer negotiated; insurer paid small additional medical reimbursement without admission and reserved recovery from Richard. My policy remained, premium increased some. Civil settlement later reimbursed.
Mortgage no default.
County assessed penalties for unpermitted rental operation.
Who paid?
Because property owner technically responsible, county initially cited me.
Sarah showed unauthorized use, and county shifted enforcement fines to operators where allowed/waived owner penalty after compliance.
That could have cost.
It didn't.
Then repairs.
I paid $11,600 upfront.
Documented restitution claim.
The house sat empty for months.
