Dr. Aaron Feld’s testimony mattered because he refused drama.
Chloe had genuine pneumonia.
High fever.
Dehydration.
Recent sedating-drug exposure.
Could pneumonia alone cause unusual sleepiness?
Yes.
Could sedating medication compound?
Yes.
Could being restrained in casket create medical risk?
Yes.
Could he say she would certainly have died?
No.
Could he say she would certainly have survived until morning?
No.
Could he determine exact dose from toxicology?
No.
Could he determine who administered?
No.
The prosecutor asked:
“Was she dead?”
“No.”
“Was she close to normal sleep?”
“No.”
“Was confinement medically appropriate?”
“Absolutely not.”
Defense tried:
“Doctor, you cannot testify Mr. Ashford intended death.”
“Correct.”
