Chapter 11 - The Monday Meeting

Trial preparation took months.

I hated reliving.

Prosecutor Dana Walsh prepared me.

“Answer only what asked.”

“Do not guess.”

“Do not argue with defense.”

“If you don’t remember, say you don’t remember.”

Good.

I practiced.

“What did you see before Margaret pushed?”

“Ethan behind her.”

“What did he do?”

“He looked at Margaret and nodded.”

“What did nod mean?”

“I don’t know what he intended. I know what happened immediately after.”

Perfect.

No mind reading.

Margaret prepared separately.

I did not speak with her.

Good.

Then one evening, Laura called.

“Ethan wants settlement in divorce before criminal trial.”

“What?”

“He’ll concede larger share of condo proceeds, assume Bennett Grove debt, waive claim against Grant Harbor related assets, and accept supervised parenting for one year after criminal case.”

“In exchange?”

“You waive certain civil claims against him.”

“No.”

She waited.

“Not even considering?”

“No.”

“What civil claims?”

Intentional infliction? Assault/conspiracy civil, financial conversion. I wanted preserve.

“He tried to steal $875,000 and helped put me down stairs.”

“Yes.”

“Why would I waive?”

“Could secure financial outcome now.”

“No.”

She nodded.

“Fine.”

I appreciated that.

Not every victim should accept money for closure.

Later we settled property without broad waiver.

Ethan assumed most of Bennett Grove debt tied to his separate guarantee.

I received larger share of condo escrow reflecting unauthorized use of marital funds and other adjustments.

The $875,000 recovery remained separate restitution/civil process.

No alimony due comparable incomes? I had investment income, he had consulting. Fine.

Divorce finalized before criminal trial.

Grace was thirteen months.

Parenting order:

Primary custody to me.

Supervised visitation to Ethan pending criminal disposition and later review.

No Margaret contact.

Decision making with me temporarily.

Then criminal trial started.

Day one.

Jury selection.

No cameras inside.

Margaret entered in custody clothing? Usually courtroom civilian? Could be prison attire maybe not. Let's keep simple: transported, seated witness area later.

Ethan wore navy suit.

I had seen him wear it to weddings.

I felt nothing.

That was progress.

Prosecution opening did not call him monster.

Dana said:

“This case is about a financial plan that required Claire Bennett to be unable to act, and the choices made to create and exploit that condition.”

Defense said:

“A family argument, an accidental fall, and a frightened husband trying to protect failing investment have been stitched into a conspiracy that never existed.”

Fair framing.

Jury would decide.

Anna Monroe testified.

Camera authenticity.

Timestamp.

View.

She said:

“I saw ambulance and checked footage.”

Defense:

“You couldn’t hear clearly?”

“No.”

“Window reflections?”

“Yes.”

“You cannot say what nod meant?”

“No.”

Good.

The video spoke.

Thomas Reed testified.

Ethan contacted him before fall.

Prepared contingency papers based on alleged instability.

Thomas warned voluntary consent required.

He denied knowing any plan to hurt me.

Defense:

“Did Ethan ever tell you he intended Claire to fall?”

“No.”

“Did he ever ask you to falsify documents?”

“No.”

“Did you think he was seeking legal advice?”

“Yes.”

Important.

No overclaim.

Then Samantha Hale.

PR contingencies.

No instruction to lie; Ethan provided premise.

Defense tried to frame as responsible crisis planning.

Jury listened.

Then bank forensic witness.

$875,000.

Device.

Meridian.

Repayment diversion.

Motive.

The trial slowly built.

Then Margaret testified.

The courtroom changed.

Ethan stared at his mother as she took oath.

Dana asked:

“Did you push Claire Bennett?”

“Yes.”

“Why?”

Margaret took a breath.

“Because Ethan needed her hospitalized, and I wanted her frightened enough to stop fighting us.”

There.

No euphemism.

Then:

“Did Ethan tell you to push her?”

“No.”

The defense visibly relaxed.

Then Margaret continued:

“He told me he wouldn’t stop me.”

The room went still.

She described:

Now?

Do what you think you have to do.

I won’t stop you.

Then the nod.

Dana:

“What did you understand the nod to mean?”

Defense objected to speculation.

Sustained partly.

Dana reframed:

“What did you do immediately after he nodded?”
