Chapter 16 - Julian’s Sentence

Julian’s sentencing came after Fernando’s.

He was thirty two.

Our marriage had been legally over three months.

He stood in federal court without wedding ring.

I noticed.

Then hated that I noticed.

His plea included:

Conspiracy to commit wire fraud.

False related-party certifications.

Unauthorized transfer of $900,000 using copied signature.

Cooperation.

State assault conviction already.

The government recommended significant reduction because he provided records and testified against Fernando.

Defense emphasized:

Joined scheme late.

Did not create shells.

Did not arrange Martin kickbacks.

Did not control Mar Azul.

Attempted some resistance.

Cooperated.

No prior criminal record.

Prosecution emphasized:

He knowingly continued.

Personally benefited.

Signed false certifications.

Used relationship to obtain information.

Stole wedding money.

Then my statement.

I almost did not give.

I said:

“Julian did not marry me only for money. I believe he loved me.”

He looked up.

Then:

“That makes his choices more serious to me, not less.”

Silence.

“He knew I trusted him and used information from that trust. He knew his father’s scheme was dishonest and kept me outside it because he wanted both the marriage and the benefit.”

Then:

“On our wedding night, when I refused to accept violence as normal, he slapped me.”

Then:

“I do not ask the court to punish him for being Fernando’s son. I ask the court to punish what he chose after he knew.”

That was all.

Julian spoke.

“I spent years telling myself I was different from my father because I felt guilty.”

Then:

“Guilt is not refusal.”

Good.

“I told him no and then did what he wanted later.”

Then:

“I loved Valerie and decided I could keep one part of my life clean while participating in fraud with the other.”

Then:

“There were not two lives.”

Exactly.

He apologized.

No request.

Sentence:

Forty six months federal imprisonment, restitution, supervised release, financial restrictions.

State probation tolled/managed around custody.

No decade.

He had cooperated.

Some people thought light.

The law balanced.

Then Monica.

She pleaded early but obstructed after wedding.

Sentence:

Thirty two months federal custody.

Restitution.

Forfeiture of traceable proceeds.

Professional accounting bar? She may be CPA? Let's say not licensed CPA, so no license. She could be barred from fiduciary roles during supervision.

Then Martin Cole.

Eighteen months.

Restitution.

Age.

Cooperation.

Then Beatrice.

No criminal charge under cooperation agreement.

Civil restitution $212k.

Her divorce settlement.

Fernando’s legitimate marital assets still substantial even after forfeiture.

Court divided.

Beatrice received enough for independent life.

Not penthouse wealth.

Comfortable.

She sold designer jewelry? Some marital, some personal. She chose.

Then Fernando appeal.

He challenged loss calculation and evidentiary rulings.

Major convictions affirmed later.

One money laundering count vacated on technical grounds, sentence reduced by five months.

No exoneration.

Then asset recovery.

Mar Azul $2.3m forfeited portion.

Condo sold.

After mortgage and tracing, $1.6m net forfeitable.

Monica settlement.

Julian restitution.

Martin.

Crime insurance.

Sterling civil recovery.

After years, Sterling recovered approximately $7.7m of the $8.13m vendor loss through combined restitution, forfeiture distributions, insurance and civil settlements, net of double recovery rules.

The rest remained unrecovered judgment/expense.

Wedding $900k:

$150k still account.

$250k Redwell received in good faith, later offset through Vance civil settlement? The $500k margin call benefit eventually recovered partially from liquidation. Through Julian/Fernando restitution and asset recovery, Valerie/ father got full $1.2m? Since $300k frozen + recovery. The $900k could be restored over time from restitution. Let's say all $900k principal ultimately restored to Daniel's gift trust over four years through frozen funds, Julian settlement, and Vance asset sale. No windfall, no interest full.

I did not keep the gift personally?

My father said:

“It’s yours.”

I said:

“Put it in trust until I know what I want.”

Later I used part to buy own apartment, not marital.

Then Sterling legal fees millions.

Net recovery did not make company whole on time/cost.

But control fixed.

Then public.

Headlines faded.

Another scandal replaced.

Good.

Then prison.

Julian surrendered.

I did not go.

Beatrice did.

She hugged him.

I didn't judge.

Then he asked through attorney if he could write me from prison.

I said:

“One letter.”

Not because reconciliation.

Because I wanted final answer to one question.

May you like

What did he think when he slapped me?

The letter arrived two months later.
