Chapter 15 - Guilty

Daniel was found guilty of first degree murder in Rebecca Bennett’s death.

Guilty of conspiracy and attempted murder against me.

Guilty of bribery.

Guilty of multiple wire fraud and embezzlement related counts involving Whitmore.

Guilty of unlawful administration of a sedative without consent.

Not guilty on one broader count alleging he had completed theft of the full $500,000 bribe amount because the second $250,000 never left Whitmore.

That mattered.

The state did not get to call unfunded money stolen.

The jury separated.

Then one false records count acquitted because evidence showed Dr. Hale, not Daniel, personally altered the record and conspiracy proof on that specific act was insufficient.

Again.

Precision.

Daniel stared forward.

No collapse.

No scream.

Then looked at me.

I looked back once.

That was all.

Sentencing came later.

For Rebecca’s murder, life imprisonment with parole eligibility only under state law after lengthy minimum period.

For attempted murder and conspiracy against me, additional years partly consecutive.

Financial counts added penalties and restitution but did not magically extend forever.

Effective:

Daniel would almost certainly spend the rest of natural life incarcerated.

He was thirty eight by sentencing.

Then victim statements.

Julia spoke.

I spoke.

Vanessa declined.

My statement:

“You called my daughter useful before she was born.”

Then:

“She will grow up knowing she never owed you usefulness.”

I looked at Daniel.

“You treated women as bridges between yourself and whatever you wanted.”

Rebecca’s money.

My company.

Vanessa’s pregnancy.

Grace.

Then:

“No person is a bridge you own.”

Daniel cried.

For first time.

Maybe genuine.

Then he spoke.

“I loved Claire.”

I did not flinch.

“I loved Rebecca too.”

Julia stiffened.

Then:

“That is the worst part.”

He swallowed.

“I kept believing love meant I deserved access to whatever they had.”

There.

Then:

“When they threatened to take it away, I treated them like enemies.”

He admitted some.

Not full legal confession? He was convicted. Fine.

Then:

“I killed Rebecca.”

Julia sobbed.

“I tried to kill Claire.”

No appeal strategy? His lawyers would hate. But after verdict/sentencing statement he may confess. It could impact appeals. Maybe he chooses. Fine.

Then:

“I am sorry.”

No forgiveness request.

Judge imposed.

Daniel left.

Then civil consequences.

Whitmore sued Daniel for fraud losses.

Insurance carrier subrogation.

His personal assets:

Investment account.

Retirement.

Share in joint house.

No Whitmore shares.

A civil settlement assigned much of his available nonexempt assets toward restitution and judgments.

No confiscation of everything beyond law.

Then divorce finalized.

Joint home sold.

Equity after mortgage, fees, and traced contributions:

About $410,000.

Prenup and marital accounting awarded me $238,000.

Daniel’s share subject to restitution/lien.

No alimony.

Grace custody:

I received sole legal and physical custody.

Daniel’s visitation suspended indefinitely due life sentence and attempted murder of mother.

Parental rights were not automatically terminated.

Later court would address.

Then name.

I restored maiden name:

Claire Eleanor Whitmore.

Grace remained Grace Bennett initially.

At school age she could decide? For infant I considered.

I petitioned to change to Grace Whitmore.

Daniel objected from prison.

Court reviewed best interest.

Given my sole custody, Daniel’s crimes, and the fact Whitmore was my family name, court approved:

Grace Eleanor Whitmore.

No revenge.

Identity.

Then Daniel appealed criminal convictions.

Expected.

Appeals take time.

I did not build life around calendar.

Then one evening after sentencing, Grace laughed for first time.

A real laugh.

Six months old.

I started laughing too.

Then crying.

She looked offended.

I said:

“Sorry.”

May you like

She laughed again.

That sound mattered more than guilty.
