Chapter 12 - Daniel’s Defense

Daniel’s defense had three pillars.

First:

He never genuinely intended my death.

The hospital conversation was “fantasy talk” born from anger.

Second:

Hale manipulated him and exaggerated for plea deal.

Third:

Financial fraud was separate and motivated prosecutor to paint Daniel as murderer.

The recording made first pillar difficult.

Daniel:

Make it look like a complication.

Then:

Half tomorrow. Rest after funeral.

Not metaphor.

Notebook:

Hale wants 500.

Same hospital. Easier.

Not fantasy.

Then syringe.

Cash.

Sedative.

Attempt.

Defense said he only intended to frighten me into estate changes.

That was not better enough.

Then Rebecca.

Hale testimony.

Payment.

Toxicology.

Chart alteration.

Complaint.

Motive.

Defense argued Rebecca truly had complications and Hale caused death independently to obtain money.

Why would Hale kill for money if Daniel did not ask?

They suggested Hale extorted after.

But Daniel’s emails:

I need certainty.

Then payment.

Then current pattern.

The jury would decide.

Then financial motive.

Whitmore audit.

Daniel diverted $827,000 gross suspicious funds.

After legitimate credits, prosecutors charged around $612,000 as fraudulent.

Recovered:

$213,000 from frozen accounts.

Vanessa restitution.

Insurance.

Net Whitmore loss after recoveries eventually around $274,000 plus audit/legal costs.

No claim he stole twelve million.

Good.

Then why murder me?

Multiple.

Then Daniel’s personal debt.

He had lost money in a commercial development named Potomac Junction.

Another investment loss.

He needed liquidity.

When debt rises, spouse assets become solution.

Then prenup.

He hated.

Texts to friend:

Then after pregnancy:

He equated Claire’s property with family property.

Then Vanessa.

She believed partly.

Then first wife insurance.

He used Rebecca inheritance to pay debts and start career.

By time he met me, most gone.

He presented himself as successful widower.

I asked Detective Cole once:

“Did he love Rebecca?”

She said:

“Not evidence question.”

Right.

Could love and kill.

Terrifying.

Then I remembered Daniel at Grace’s ultrasound.

He cried.

Was that fake?

Maybe not.

He later called her useful.

Both.

I refused to rewrite every memory.

Then trial prep.

Prosecutor, Assistant Commonwealth’s Attorney Natalie Shaw, told me:

“Cross examination will be difficult.”

“I know.”

“They will ask why you stayed after bruising.”

“I know.”

“Why you trusted Hale.”

“I know.”

“Why you didn’t call police immediately after tea.”

“I needed evidence.”

“Yes.”

Then:

“They may imply compliance attorney should have known better.”

I laughed.

“Of course.”

Knowledge does not vaccinate against abuse.

Then I asked:

“Will Vanessa testify?”

“Yes.”

“Hale?”

“Yes.”

“Julia?”

Limited.

“Me?”

Yes.

Then custody.

Daniel requested photos of Grace through counsel.

I denied pending evaluation.

Court appointed guardian ad litem.

The GAL said a child can later have information about father without granting him direct access now.

Good.

Then Daniel wrote to court:

Claire is using baby as revenge.

The GAL reviewed hospital recording.

Response:

Current restriction is safety based.

Good.

Then I received a package from prison mail accidentally? No, counsel prevented.

No more.

Then Grace began smiling.

Four months old.

I was preparing to testify that her father tried to kill me.

Two truths in same house.

I held her.

“You don’t owe me hatred.”

She smiled.

Drool.

Excellent.

Then trial began.

Daniel looked at me across courtroom.

For first time since hospital.

He mouthed:

I love you.

I turned toward jury.
