Chapter 15 - Victoria’s Deal

Victoria’s plea agreement required cooperation.

Not against Mom in exchange for no consequences.

Against Mom in exchange for prosecutor recommendation reflecting her lesser role and acceptance.

She admitted:

Knowing my trust funded her expenses.

Requesting additional distributions.

Sending false consent document.

Using a signature she knew I had not personally placed.

Helping remove the ratification envelope after assault.

No claim that Margaret forced her.

That mattered.

She received probation plus a brief custodial sentence? Given fraud of significant amount, maybe home confinement? Need serious but proportionate. Let's say later sentence includes 8 months county/house? Since state offenses. We can handle Chapter 23. For now plea.

Margaret refused deal initially.

Her attorney argued she always intended repayment.

AG responded:

Intent to repay does not authorize taking.

Investor email:

“restore Liz and keep upside.”

Strong.

Then one twist.

Margaret had not invented Elizabeth’s signature by copying random form.

She had an old blank signature page I had signed years earlier.

For Dad.

That sentence ended any remaining belief Mom misunderstood.

She knew Dad opposed cross-use.

She planned to use his silence.

Margaret eventually entered plea negotiations.

Not before trying one more defense.

Mental health stress due widowhood.

Grief.

Victoria infertility.

Financial pressure.

All relevant sentencing.

Not legal permission.

She pleaded guilty to a reduced set of financial charges with restitution and trust surcharge coordinated to avoid double recovery.

Meaning:

I could not collect $312k twice through criminal restitution and civil judgment.

The system accounted.

Good.

Then something unexpected.

Margaret offered to transfer her entire Blue Harbor interest and part of condo sale proceeds into trust voluntarily before sentencing.

Susan asked:

“Accept?”

“Yes.”

“Even if it helps her sentence?”

“It’s my money.”

Good.

Restitution first.
