Chapter 7 - The Clip He Wanted
Michael’s attorney argued he was trying to document my “violent tendencies.”
The hidden camera was misguided.
The provocation was inappropriate.
But he never intended for Olivia to be hurt.
Rebecca looked at me across my kitchen table.
“Expect that defense.”
“I do.”
“Do you believe him?”
“That he didn’t want Sarah to hit Olivia?”
“Yes.”
“Does that matter?”
“Yes.”
It mattered because truth mattered.
It did not make him safe.
He watched his mother slap our two year old daughter.
Instead of calling 911, he waited until I struck Sarah.
Then he said:
Good.
The clip he wanted.
Then his preexisting narrative.
Police obtained texts between Michael and a divorce attorney.
Consultation began seven weeks before incident.
I had no idea.
Attorney:
Have there been incidents of physical violence?
Michael:
Not yet.
Not yet.
Then:
She has a temper with Mom.
Attorney:
Arguments are not enough for emergency custody.
Michael:
What would be?
Attorney’s response was ethical:
Do not manufacture conflict. If there is genuine violence or child safety concern, document and call law enforcement.
Michael did not tell attorney about planned camera.
Then six days before incident:
Michael:
If Emily strikes my mother in front of the kids, is that relevant?
Attorney:
Potentially, depending circumstances. Again, do not provoke or stage anything.
Clear warning.
Then Michael prepared an affidavit.
Draft.
Never filed.
Date created Saturday night.
Before the assault.
I, Michael Carter, have become increasingly concerned about my wife Emily’s volatile behavior toward my mother in the presence of minor children.
Then blank paragraph:
On Sunday, Emily physically assaulted Sarah Mitchell after a disagreement involving the children.
Sunday had not happened yet.
He wrote event before event.
Then:
I request temporary exclusive possession of marital residence and temporary primary care of Olivia.
My hands went numb.
He wanted me out.
Sarah had shouted:
Michael will throw you out on the street.
Not random insult.
Part of plan.
Then house.
Who owned?
I purchased it two years before marriage using Cedar & Bloom income and a small inheritance from my father.
Michael’s name was added to title after we refinanced together.
So marital property questions existed.
He could not simply throw me out.
But emergency protective orders can temporarily decide residence.
He wanted leverage.
Then custody.
Why did he want Olivia if he allowed her to be used as bait?
Maybe because custody wins bargaining power.
Maybe because he loved her.
Both.
People can love children selfishly too.
Then business.
A second draft affidavit:
Due to Emily’s anticipated legal crisis, Michael Carter requests temporary authority to coordinate Cedar & Bloom operations.
Not filed.
No corporate mechanism for spouse to request that from court.
He misunderstood governance.
But he intended to approach board.
Then one investor message:
If Emily becomes unavailable, would you support me running Monday review?
Investor:
If Emily is actually unavailable and board approves.
Michael:
Understood.
He was building possibility.
Then Sarah’s compensation.
Camera audio showed she wanted something.
Financial records answered.
Michael had promised to pay her $68,000 after “family resolution.”
Why that amount?
Sarah’s upcoming gallbladder surgery plus debts.
She owed:
$21,000 medical.
$17,000 credit cards.
$30,000 personal loan from Rachel.
Total about sixty eight.
Michael had written:
After Monday, clear Mom.
Where would money come from?
Bright Vale Consulting.
The shell vendor.
I stared.
Michael planned to keep the embezzlement going.
Then Tyler.
Rachel brought him to my house after police allowed.
He wanted to see Olivia.
She toddled toward him.
Cheek yellowing.
Tyler cried.
“I’m sorry.”
I knelt.
“You didn’t hit her.”
“I had the hot dog.”
“You were going to share.”
“Grandma told me not to.”
“That was her decision.”
Then Olivia handed him her stuffed bear.
Tyler hugged it.
