Chapter 17 - Constance’s Appeal

Constance appealed the trust court removal.

Not surprising.

Her lawyers argued:

Procedural errors.

Insufficient proof she personally arranged false sample.

Arthur’s testimony unreliable.

Grace biased.

Northstar report could have been hidden by Julian alone.

Some points not absurd.

Appeals are not villainy.

The appellate court reviewed.

Meanwhile her grandparent visitation appeal? She had no final right, so not much.

The trust appeal took eleven months.

Outcome:

Removal affirmed.

Surcharge reduced slightly because some investigation costs allocated to trust generally.

From $486,000 to $431,000.

No retrial.

No restored control.

That was important.

Legal system corrected numbers without erasing core finding.

Constance paid.

She sold jewelry and a vacation property.

Still wealthy.

Then she sent letter to Caleb through court approved counsel channel.

Not directly.

I asked therapist.

Caleb wanted to read.

Letter:

Caleb,

I treated you as if a laboratory result determined whether you deserved kindness. That was wrong even if the result had been true.

I stopped.

That sentence was good.

She continued:

I lied to myself that protecting the Hartwell family justified humiliating you.

Also good.

Then:

Your father failed you because I taught him fear.

I frowned.

Partial blame shift.

At end:

I do not ask you to see me. I hope someday you will.

Caleb read.

“What do you think?”

“She says Dad failed because of her.”

“Yes.”

“Is that true?”

“Partly.”

“He chose too.”

“Yes.”

Caleb nodded.

“Then she should say that.”

I smiled.

“Smart.”

He wrote nothing back.

No obligation.

Constance did not follow up.

For six months.

Then her attorney notified she completed counseling and would not renew visitation petition.

Why?

No explanation.

Maybe learned.

Maybe tired.

Maybe strategic.
