Chapter 8 - Vivian’s Deal

Vivian pleaded first on the financial case.

Not the assault case.

Her attorneys negotiated with federal prosecutors.

She admitted:

Knowingly participating in concealment of DMC Advisory as a related party from Cross Hospitality’s lender.

Receiving sham or excessive payments through Cross Interiors beyond disclosed services.

Directing employees to classify certain distributions as vendor retainers.

Attempting to delete or access entry camera after my assault.

The last was state, coordinated.

She did not admit planning chemical attack.

Evidence did not show.

She did admit telling Daniel to lie afterward.

Then restitution.

Forensic audit separated legitimate Cross Interiors work.

This was crucial.

Gross payments to Vivian’s business over three years:

$8.2 million.

Legitimate design/furnishing work at reasonable adjusted value:

$5.9 million.

Improper excess or sham retainers:

$2.3 million.

Not all eight million stolen.

Vivian’s personal benefit after costs:

~$1.4 million.

She forfeited investment account, jewelry? Forfeiture traces. She sold vacation condo partly.

Restitution to Cross Hospitality after insurer offsets.

Sentence recommendation around 30 to 42 months.

She was fifty eight.

No prior convictions.

She cooperated with broader corporate investigation.

Judge eventually imposed three years.

Plus supervised release.

State obstruction sentence concurrent.

No assault conviction because she didn't strike me. Verbal cruelty not charge.

She entered custody months later.

Before sentencing, she spoke.

“I believed Cross Hospitality belonged to our family in a way that made corporate restrictions feel temporary.”

There.

Then:

“I believed Elena was using her father’s company to take what was ours.”

Judge:

“Did Hartwell create the undisclosed transactions?”

“No.”

“Did Elena?”

“No.”

“Then what did she take?”

Vivian had no answer.

At sentencing I submitted no recommendation.

My statement:

Vivian watched me scream that I could not see and chose to protect a camera password instead of helping.

That was all.

Then her apology.

She sent through counsel before custody.

Elena,

I am sorry I did not call for help.

Not enough, but start.

Then:

I am sorry I laughed.

Then:

I am sorry I tried to erase the recording.

No request.

I filed.

No response.

Then Daniel’s mother went to prison.

The media framed:

MATRIARCH FALLS AFTER ATTACK ON DAUGHTER IN LAW.

But financial fraud caused much of sentence.

I hated conflation.

I corrected once through Sarah’s written statement:

Mrs. Cross’s federal conviction relates to financial conduct and concealment. The assault case against Daniel Cross remains separate.

That mattered.

Then Cross restructuring finalized.

Family lost voting control.

Meridian Hospitality Partners invested $22 million.

Hartwell extended maturity by two years.

Two hotels scheduled sale.

Related party vendor contracts terminated.

Professional board chair appointed.

Vivian removed.

Daniel already suspended, later terminated for cause after internal findings.

Cross Hospitality rebranded some governance but kept name.

Employees stayed.

Hotels stayed open.

The empire did not vanish.

The dynasty control did.

Then my father said:

“They could rebuild.”

“Do you want?”

“As lender, yes.”

“Even after?”

“Loan repayment is easier if borrower survives.”

Finance has no revenge.

I learned.

Then Cross Hotel employees wrote me? Some blamed. One anonymous:

Because of you, our bonuses froze.

That hurt.

But audit/restructure responsible.

Still consequences ripple.

I did not respond.

Then another employee wrote:

My paycheck cleared. Thank you for not pushing your father to foreclose.

I had not.

No hero.

Then my eye surgery.

At four months, Dr. Greene recommended corneal transplant for right eye due dense central scar.

Risks.

Rejection.

Infection.

Not guaranteed.

I said yes.

The surgery went well initially.

Weeks later, visual acuity improved to 20/120.

Then 20/80.

Left eye 20/40 with correction.

I could drive eventually with glasses, though glare at night difficult.

Not blind.

Not untouched.

The first time I drove old Honda again, Dad followed three cars back despite promising not.

I called at red light.

“Stop following.”

“How did you see me?”

“Your Volvo is ugly.”

He laughed.

May you like

I drove alone.

That felt like my own empire.
