Chapter 11 - The First Arrest

The first person sentenced was not Julian.

Peter Calloway.

The notary.

He pleaded guilty in state court to official misconduct/false notarization.

No jail beyond suspended? He got 60 days suspended, probation, fine, commission permanently revoked. He cooperated.

Small role.

Then Eleanor.

Her charges split.

Misdemeanor assault for slap.

Conspiracy/forgery related to false trust witness.

Wire fraud conspiracy? Federal prosecutors considered. They ultimately charged one federal conspiracy count because she knowingly supported false document used in bank communications and sham vendor payments.

She pleaded.

Why?

Victoria’s texts.

Bank records.

Recording.

Eleanor’s lawyer knew trial could be worse.

Plea statement:

“I signed a trust document as a witness although Genevieve Vance did not sign in my presence and I knew the signature had been placed there by others.”

Then:

“I received funds from Vance Development through a consulting arrangement when I did not provide the services described.”

Then assault:

“I struck Genevieve in hospital.”

No minimizing.

At sentencing, Eleanor tried to speak about Julian.

Judge stopped:

“This is your sentencing.”

She looked shocked.

Sentence:

Eighteen months federal custody for conspiracy conduct, followed by supervised release, with state assault sentence concurrent/minor and restitution.

She was sixty three.

No prior record.

Not ten years.

She cried.

Then wrote me.

Not apology.

“You took my son and now you’ve taken me.”

I did not answer.

Prison did not create insight immediately.

Then Victoria.

She had not yet pleaded.

Her cooperation targeted Julian and company fraud.

Prosecutors offered:

Plead guilty to conspiracy to commit wire fraud, access-related computer fraud? She used funeral portal without authorization and participated in forged docs and vendor fraud. Could be 3 counts.

She would testify.

Recommended sentence 30–42 months.

Restitution.

Forfeit improper gains.

She accepted.

At plea, she admitted:

Affair.

Vale invoices.

False trust.

Death record initiation.

Board consent fabrication.

Mercer Capital plan.

She cried when prosecutor asked:

“Did you intend Genevieve to die?”

“No.”

“Did you participate in planning how to exploit her death if it occurred?”

“Yes.”

That distinction became public.

Then why enter hospital?

“I wanted Julian to prove he had chosen me.”

I read transcript.

That line explained lingerie more than any financial scheme.

Cruelty for status.

She wanted me to see.

Then:

“Did you laugh?”

“Yes.”

“Why?”

“I wanted her to feel powerless.”

No excuse.

Victoria received three years two months after substantial assistance, restitution and forfeiture.

She had to forfeit $510,000 in remaining assets traceable to improper Vale payments, including investment account and luxury car proceeds.

Not every dollar she ever earned.

Legitimate salary hers.

Then Vance Development recovered via insurer, forfeiture, restitution.

Company losses shrank.

Julian’s trial remained.

He refused plea.

He said he had authorization.

He blamed Victoria.

Blamed Eleanor.

Blamed me.

The man who once said he loved building beside me now argued I had promised him equity orally.

No document.

Prenup contradicted.
