Chapter 18 - Robert’s Sentence
Dad’s sentencing was different.
He had cooperated extensively.
He sold house.
Paid restitution.
Turned over records.
Testified against nobody beyond truth already in documents.
No prior record.
He admitted his role early after separation from Mom.
But he still:
Signed trust distributions.
Failed to stop fraud.
Participated in concealing the prior injury.
Left Eli with Ryan despite safety restriction.
Waited instead of calling 911.
The judge imposed a short county jail term with a larger suspended portion, followed by supervised probation and permanent disqualification from serving as trustee or fiduciary for Eli.
He was not spared.
He was not treated like mastermind.
After release, Dad moved into a one bedroom apartment.
He asked through Dr. Chen if Eli wanted contact.
Eli said:
“Letters first.”
So letters.
For six months.
Dad never asked for forgiveness.
Then Eli asked for a supervised visit.
Public library meeting room.
Dr. Chen present initially.
I sat nearby.
Dad entered.
Stopped ten feet away.
“Hi, Eli.”
“Hi.”
No hug.
No tears theatrically.
Dad said:
“I’m sorry.”
Eli answered:
“I know.”
Then:
“Why didn’t you call 911?”
Dad looked down.
“Because I was afraid your grandma would hate me and Ryan would get arrested.”
“Was that more important than me?”
“No.”
“Then why?”
Dad cried.
“Because I acted like it was.”
Eli considered.
“That’s stupid.”
“Yes.”
They played chess.
Twenty minutes.
Eli won because Dad was distracted.
On drive home, I asked:
“How was it?”
“Okay.”
“Want again?”
“Maybe.”
That was all.
Months became occasional visits.
Never unsupervised initially.
Trust returned in pieces.
Not because Dad was grandfather.
Because he accepted no.
Then Lakeview completed recovery accounting.
Through:
House sale lien.
Ryan restitution.
Mom’s accounts.
Dad’s payments.
529 administrator reimbursement.
Frozen Ryan business funds.
Total restored over two years:
About $223,000 principal and negotiated growth components.
Not every legal fee recovered.
Trust balance eventually returned to roughly what it would have been within a reasonable range, adjusted for market conditions.
No magic exact restoration.
Professional trustee remained.
I would never control it alone either.
That was my choice.
