Chapter 5 - The First Child

The 2022 incident involved my cousin Carol’s nine-year-old grandson, Ben.

Not seriously injured.

A trailer rolled backward unexpectedly while Walter was repositioning it.

Ben was knocked into a wooden fence.

Bruised shoulder.

Scraped elbow.

No hospital admission.

Family called it “a scare.”

I vaguely remembered Mom saying Ben “fell near boat.”

That was all.

The trust’s property insurer received claim because fence and trailer damaged.

During loss-control review, insurer discovered children had been allowed to “help guide” vehicles near boat storage.

They issued requirements:

Only licensed adults in active maneuvering area.

One adult spotter.

No children within marked backing zone.

Verify cameras.

Use wheel chocks/other standard safety equipment as required by operator/manual? Could avoid detailed. Keep general.

Trust company documented.

Walter signed acknowledgment as property-use manager.

Derek signed too because he regularly handled boat/trailer.

I stared at scanned page.

Derek Carter

Two signatures.

Three years before Eli.

Then email from Elaine:

Further material safety violations may result in review of recreational-use privileges and replacement of on-site property manager.

Not automatic loss of house.

Walter would not be thrown onto street.

But he could lose control.

The thing he valued most.

Then I remembered Dad:

“Don’t turn this into emergency.”

Not primarily ambulance cost.

The trust.

He knew report could trigger review.

Then Julia explained property structure.

Grandma Evelyn bought lake house decades earlier.

In 2004 she placed it in irrevocable Carter Lake Preservation Trust.

Purpose:

Keep property from fragmented family ownership.

Provide Walter and June lifetime recreational occupancy/use.

After both no longer used/lived, benefit shifted equally to their children Megan and Derek, subject trustee powers to retain/sell.

Independent trustee:

Granite State Trust Company.

Walter was designated family property coordinator, not owner.

He could manage routine:

Boat storage.

Maintenance.

Guest scheduling.

Minor contracts.

But not:

Sell.

Mortgage.

Change beneficiaries.

Ignore insurance conditions.

After 2022 incident, Granite State kept him as coordinator only after he agreed written safety plan.

So another child injury from same risk could result in removal.

Then Dad’s threats over years made new sense.

“If you disrespect rules, I’ll take you out of lake house will.”

There was no lake house will.

He could control invitations while he held lifetime use.

He could make weekends unpleasant.

He could not erase my remainder interest.

Julia said:

“Do not confront him using this yet. Let trustee and investigators handle.”

Agreed.

Then driveway camera.

Granite State paid security bill through trust.

The system had local DVR and cloud backup retained for thirty days.

Walter apparently forgot.

Local recording gap.

Cloud remained.

Police obtained proper preservation/request.

Footage.

I did not see immediately.

Detective Aaron Walsh later summarized.

At 1:47 p.m.:

Derek moves SUV/trailer into driveway.

Eli beside him.

Derek points toward rear passenger side.

Eli stands near trailer.

Derek enters SUV.

Nora on porch filming.

Walter walks from dock, sees Eli.

He gestures.

Audio unavailable.

Derek leans out window.

Walter walks away.

Then trailer moves.

Eli is struck and falls.

Megan runs from house.

Everyone gathers.

After ambulance leaves, Walter walks into mudroom.

Four minutes later, local camera recording system stops storing.

Cloud continues because camera itself active.

Then Walter returns to driveway and says something to Derek.

Later June moves bent plate pieces.

Derek moves SUV slightly after police? Wait police might have arrived before ambulance left. Need timing. Local officers came during EMS? Seed says emergency. Let's say police did not arrive before ambulance due call type? But EMS and sheriff simultaneously likely. Could be camera deletion after ambulance but before local officer arrival. Fine.

The most important:

Walter had seen Eli’s position before the accident.

He did not stop Derek.

What gesture?

No audio.

Could not infer.

Then later police asked Walter:

“Did you know where Eli was standing?”

His initial statement:

“No. I was by dock.”

Footage contradicted.

He was in driveway.

Then local DVR deletion.

Walter said system “glitched.”

Cloud showed him access panel.

Not proof delete alone.

Forensic logs later:

Manual deletion command from admin account.

Account:

Walter.

My father had moved from minimizing to destroying evidence.

Then June called me.

Crying.

“Your father could be charged.”

“Yes.”

“He panicked.”

“Yes.”

“Can you tell police you don’t care about video?”

“No.”

“Megan, he’s seventy-one.”

“Eli is five.”

Silence.

Then:

“He was trying to protect family.”

I said:

“From whom?”

She had no answer.

Then Julia emailed a trust notice.

Granite State had suspended Walter’s property-management authority pending investigation.

He and June retained occupancy/use.

But:

No towing.

No boat/trailer operations.

No control over security system.

Independent manager appointed.

Dad had tried to save control by stopping my call.

He lost control anyway.

Then, according to Detective Walsh, Walter made the next mistake.
