Chapter 16 - Lucas Breaks First

Lucas was sentenced before Margaret.
His cooperation mattered.
So did his conduct.
Federal guidelines complicated.
The judge considered:
No prior felony.
Substantial cooperation.
Direct role creating documents.
Personal benefit.
Obstruction.
Abuse of corporate authority.
He received thirty eight months in federal custody, followed by supervision, restitution jointly with Margaret subject allocations.
Not nothing.
Not decade.
He cried.
Then judge said:
“You were not a child following your mother.”
Important.
Lucas nodded.
Then before surrender date, he requested meeting with me.
I agreed.
Aaron present initially, then left once legal matters settled.
Lucas looked older.
“Daniel.”
I waited.
“I’m sorry.”
“For?”
He swallowed.
“Making you answer that.”
Good.
Then listed.
Signature.
Company.
Elena.
Phone.
Video.
Basin.
Then:
“I didn’t stop Mom.”
“No.”
“I laughed.”
“Yes.”
He cried.
“I hated you.”
“Why?”
“Dad trusted you.”
I nearly laughed sadly.
“Dad criticized me constantly.”
“He gave you fifty two.”
There.
Shares became love score.
“You thought control meant love.”
“Yes.”
Then:
“Mom said Dad only did it because you were oldest.”
“Maybe.”
“Letter says otherwise.”
He had seen discovery.
“Yes.”
Then:
“I spent years trying to prove he was wrong.”
“And?”
“I proved him right.”
Harsh.
Not necessarily forever.
I said:
“You proved he was right at that time.”
Lucas looked.
“Do you think I can come back to company?”
“No.”
Immediate.
He flinched.
“Ever?”
“That is not my decision alone, but I would oppose executive return.”
“Why?”
“Trust.”
He nodded.
Then:
“Do I keep shares?”
“Your trust rights are yours subject court and trust.”
He looked surprised.
“You’re not taking?”
“I cannot and would not just because angry.”
Then:
“Restitution may reach distributions.”
“I know.”
Good.
Then Elena.
“Can I apologize?”
“Through counsel. She chooses.”
He nodded.
Then:
“Can I meet Owen someday?”
“No.”
His face broke.
“Never?”
“I said no now.”
Important.
Then:
“You filmed his mother being humiliated while pregnant.”
He closed eyes.
“I know.”
“No child needs access to every relative.”
He nodded.
Then:
“I hope someday.”
Hope is his.
Not right.
Then he surrendered.
Prison.
No family intervention.
Margaret called him traitor through permitted legal message before no contact? She was awaiting sentencing. She blamed his cooperation.
He did not respond.
Then her state case.
After federal conviction, state prosecutors offered plea for assault, unlawful restraint/coercion related to Elena, with sentence potentially concurrent partly but additional conditions and no contact.
Margaret accepted.
Why?
Federal conviction changed risk.
She admitted:
She placed foot on Elena.
She grabbed/shoved on prior occasions.
She participated in withholding phone.
She coerced signature using threats.
No serious bodily injury.
She received a state sentence largely concurrent with federal incarceration plus protective order.
Then federal sentencing.
Margaret faced more because leadership, amount, obstruction.
Age sixty seven.
No prior record.
Restitution ability.
Her lawyer presented medical conditions.
Prosecutor asked meaningful incarceration.
I submitted written statement:
My mother should be sentenced for what she did, not for being difficult, not for being controlling, not for hurting my feelings. I ask court not to treat family relationship as reason to reduce accountability.
Elena wrote:
I do not need Margaret to suffer for me to recover. I do need the record to say that being pregnant, being a daughter in law, and living in a family house did not make me her property.
Strong.
Judge imposed sixty six months federal custody, followed by supervision, restitution, with state sentence concurrent as ordered.
Five and a half years.
Margaret would be in early seventies upon release.
She looked toward us.
Then said to judge:
“I am sorry.”
The judge asked:
“For what?”
Margaret froze.
Then:
“For thinking family gave me authority I did not have.”
That was first real sentence.
Maybe coached.
Maybe not.
Then:
“For Elena.”
She turned slightly.
“I was cruel.”
Elena cried.
No response.
Then deputies took.
Outside, reporters.
No statement.
At home, Owen crawled toward me.
I picked him up.
The entire empire Margaret tried to control suddenly felt absurd.
A baby did not know Carter Industrial.
He knew bottle.
Warmth.

Voices.
We had time to teach better.
