Chapter 8 - Derek’s Proffer

A proffer is not a confession carved in stone.

It is negotiation.

Derek sat with federal/state prosecutors and lawyers.

I was not there.

Later victim advocate summarized what became usable.

He admitted:

He created Bennett Urban Holdings.

He hid full debt load from me.

He planned to ask me to sign guarantee, voting proxy, POA after wedding.

He copied my electronic signature onto preliminary net-worth document.

Why?

“To keep Eastpoint process moving.”

Did he think that was legal?

He said:

“I told myself it was draft.”

Then:

He knew signature represented my acknowledgment when I had not given.

He admitted.

He said final guarantee would have been real signature.

He believed once married I would sign.

Why?

“Because I thought she wouldn’t walk away after public wedding.”

There.

Then trial-data leverage.

He admitted photographing screen.

Drafting leak email.

“I never intended to send unless she tried to destroy me.”

Prosecutor:

“By refusing a $2.4m guarantee?”

Derek reportedly said:

“I was desperate.”

Then mother.

Did Patricia know copied signature?

Yes.

Did she tell him to?

She said:

“Use what you have to keep application alive.”

Did she specifically know it was copied without consent?

Derek:

“She knew Claire hadn’t signed.”

Bad.

Did Patricia plan physical violence?

“No.”

Did she tell him to assault Claire?

“No.”

Did she know he had been violent before?

“Yes.”

Did she encourage taking phone/coercing?

“Yes.”

Did she expect Claire to sign voluntarily?

“She expected me to make marriage feel irreversible.”

That phrase.

Then cake.

Whose idea?

Patricia suggested embarrassing “cake smash.”

Derek intended to press my face lightly.

He was angry because I had been distant.

He used more force.

Did he intend injury?

“No.”

Did he see blood?

Yes.

Why still threaten?

“I panicked and thought she was turning everyone against me.”

Then:

“Did you love Claire?”

“Yes.

Proffer notes do not make poetry.

Then he offered plea:

Wedding assault.

Attempted financial fraud/forgery-related count.

Attempted coercion/extortion.

Obstruction? Not yet.

In exchange for no charge against Patricia? Prosecutors refused blanket immunity.

They offered consideration for cooperation.

Patricia eventually received own proffer opportunity.

She denied much.

Then I heard Derek wanted to apologize.

I said no.

Not now.

Then something happened that shifted criminal case again.

Derek was out on bond in financial case? After wedding arrest maybe released on bond with no contact due protective order.

He was ordered not to contact me directly/indirectly except lawyers.

One evening, a delivery arrived at Lena’s apartment.

A white wedding cake box.

Inside:

No cake.

A flash drive.

And a note:

You wanted evidence. Here’s what your friend is hiding.

No name.

Lena called police.

Drive contained messages between Lena and me from months before wedding.

Private texts.

How did Derek get them?

Some were screenshots from my phone.

During incident when he had taken phone.

He had copied/exported perhaps.

Messages:

I think I need to leave.

I’m scared he’ll do something if I cancel.

I wish wedding were over so everyone would stop watching.

Derek wanted to show I planned.

But sending drive through unknown delivery after no-contact order could be indirect contact/witness intimidation.

Investigators traced delivery payment to prepaid card purchased by Patricia’s assistant? Maybe too easy. Let's do surveillance showed Derek's friend Mark Ellis dropped package after Derek asked. Mark cooperated.

Text Derek to Mark:

Get this to Lena. She needs to understand Claire was planning this long before cake.

That violated order.

Derek arrested again for indirect contact/witness tampering/order violation.

Prosecutor’s willingness to offer lenient plea decreased.

His proffer protection did not cover new crime.

Then Patricia texted Derek before package:

Leave it alone.

Interesting.

For once, she told stop.

Derek ignored.

So mother not behind.

Good complexity.

Then judge revoked bond pending resolution.

Derek went into custody.

And while sitting there, he sent one message through attorney that changed divorce:

“I will enforce prenup. I withdraw challenge.”

Why?

Maybe acceptance.

Maybe strategy.

Either way, it simplified.

Then Patricia became central.

Without Derek protecting her, investigators subpoenaed her financial records.

The $310,000 she loaned Bennett Urban did not come from retirement savings as she claimed.
