Chapter 9 - The Divorce That Had Almost No Property

People assumed divorce from Mercer family would become war over millions.

It did not.

Our prenup was clear.

Ironically, Victoria had insisted on it.

Everything Elena owned before marriage remained Elena’s.

Everything Julian owned remained Julian’s.

Inheritance/trust interests separate.

My Mercer Heritage 24% separate.

My condo separate.

“Not for marriage.”

Julian closed eyes.

He stopped contesting.

Then Victoria’s side.

She had no legal standing in divorce.

She tried anyway through family pressure.

But even if one, I can leave.

Marriage is not criminal sentencing threshold.

Then her lawyer sent demand that I return “Mercer family heirloom locket” because it remained among evidence/items.

I had given locket to company counsel.

They returned after lab.

I mailed through attorney.

No need keep trophy.

The stained sheet was disposed after evidence preservation and case sampling.

The folio was repaired by book conservator.

Dad’s letter stayed.

Then the company.

Revised $63m refinancing closed.

NorthBridge imposed covenants.

No family payments without approval.

Audit continued.

One renovation postponed.

No layoffs.

One hotel in Traverse City sold later to reduce debt.

Not fire sale.

Profit.

Company stabilized.

This mattered because Victoria told everyone I would destroy it.

I didn’t.

Then employee trust.

For first time employees received full related-party report.

They were furious.

Not because every payment was fraud.

Because nobody had told them.

Trustee demanded board seat protections.

Approved.

Governance changed.

Then audit finalized gross related-party transactions.

Four years:

$14.6m.

Fair value legitimate services:

Clear unsupported/excess:

$4.8m.

Attempted but unpaid termination fee:

$7.2m.

That number became central in criminal charges.

Actual company loss not fourteen million.

$4.8m before recoveries.

Some could be civil dispute.

Prosecutors charged only amounts they believed fraudulently obtained with intent.

Against Victoria:

Wire fraud conspiracy.

Several wire fraud counts tied specific false invoices/retainers.

Attempted bank fraud related undisclosed planned termination payment.

Falsification/obstruction related altered board minutes and deletion efforts.

Against Julian:

Conspiracy on portions of consulting arrangement and lender representation.

False statement/financial fraud count tied assertion my proxy was secured.

No charge for marrying me.

No charge for being weak.

No incest nonsense.

Records.

That made case stronger.

Then Julian pleaded not guilty initially.

Victoria too.

Trial dates months away.

I wanted disappear from every legal system.

Instead, I went to work Monday.

I was an occupational therapist in a rehabilitation hospital.

A stroke patient complained his breakfast eggs were cold.

I almost laughed.

Life remained stubbornly ordinary.

I helped him practice buttoning shirt.
