Chapter 12 - Ben’s Camera

Ben hated court.
“I take pictures because I don't like talking.”
Yet his testimony became central.
He explained camera clocks.
RAW files.
Burst mode.
Video test.
Memory card chain.
No edits.
Defense expert agreed timestamps consistent within seconds.
Then images displayed.
Sophie smiling at 2:38.
Evelyn approaching.
Hand on arm.
Blue folder.
Caroline upstairs.
The later landing sequence.
Mirror with taped phrase:
I FEEL SAFER WITH GRANDMA.
Then 3:17.
Sunglasses.
Gauze.
Sophie descending.
Evelyn’s hand at her back.
The camera did not show everything.
That made it trustworthy.
No magical perfect angle.
Then Ben’s audio video.
Evelyn’s voice:
Say what we practiced.
Sophie:
But it isn’t true.
Caroline:
Don’t pressure her too hard before interview.
Evelyn:
She has to be consistent.
Sophie:
I want Mommy.
The jury heard.
Evelyn stared forward.
Then defense asked Ben:
“Did you see Mrs. Carter strike Sophie?”
“No.”
“Push?”
“No.”
“Cause fall?”
“I saw photographs later, not real-time.”
“So you cannot tell jury she intentionally injured.”
“No.”
Good.
No overclaim.
Then:
“You accepted payment from Emily?”
“No. Mrs. Carter hired and paid deposit.”
Interesting.
He was Evelyn’s photographer.
No bias money.
Then Caroline.
She looked terrible.
Admitted voice.
Admitted she heard Sophie say not true.
Why not act?
“I thought Evelyn was exaggerating a real concern.”
“After child said not true?”
“I should have stopped.”
Then:
“Did Evelyn ever tell you she planned false reports?”
“She told me she was building a record.”
“What did you understand?”
“Custody if Emily moved.”
“Did you believe Emily unsafe?”
“No.”
“Then why help?”
Caroline cried.
“Because my sister can make disagreement feel like betrayal.”
There.
Family system.
Then Daniel.
Worst.
Prosecution asked about reports.
He knew.
Counselor email.
He knew.
Mother’s questions.
He knew.
Statement draft.
He refused but did not tell Emily.
Private marital screenshots.
He shared.
Every answer hurt.
Defense tried make him appear biased after divorce.
“You are divorcing because Emily blames you.”
Daniel:
“I’m divorcing because I broke trust.”
Then:
“Do you hate mother?”
“No.”
“Love?”
“Yes.”
“Want convicted?”
“I want facts believed.”
Then:
“Did Evelyn ever say she planned to injure Sophie?”
“No.”
“Did you ever see her physically abuse before?”
“No.”
Good.
Then:
“So this accident could have been accident.”
“The fall could have been unintended.”
The room shifted.
Then Daniel continued without prompting:
“But Sophie would not have been in that locked room trying to escape if my mother hadn’t put her there.”
Prosecutor did not need more.
Then I testified.
Defense wanted show anger toward Evelyn.
Yes.
Divorce.
Yes.
Charlotte.
Yes.
Arguments.
Yes.
Have I yelled at Sophie?
Yes.
Ever grabbed to stop danger?
Once at parking lot, likely.
Bruised?
No.
Drink wine?
Yes.
Take anxiety/sleep meds? I had used short term after my father's surgery? We didn't establish. Let's avoid.
Then:
“Are you perfect mother?”
“No.”
Good.
Then:
“Did you ever threaten to keep Sophie from grandmother?”
“I set limits.”
“Did you say no sleepovers?”
“Yes.”
“Why?”
“She ignored routines and undermined rules.”
“Did that hurt Evelyn?”
“Probably.”
“Did you care?”
“Yes. But Sophie’s needs mattered more.”
Then:
“So you and Evelyn had custody-like conflict before any report.”
“No. She was grandmother. I was parent.”
That distinction.
Then blue folder notes.
Prosecutor displayed.
Not all.
Enough.
Then final photograph.
The mirror phrase.
I saw for first time large.
I FEEL SAFER WITH GRANDMA.
My daughter had been expected to read another adult’s conclusion about her own feelings.
That was Evelyn in one image.
May you like
Not a woman who wanted Sophie safe.
A woman who wanted Sophie’s voice to sound like hers.
