Chapter 16 - The Babies I Could Not Name Correctly

For years Luke called them girls.

After trial, I requested copies of every medical record.

I wanted names.

Not legal.

Mine.

Pregnancy one.

Eight weeks.

No sex result.

I had called the baby Peanut.

That stayed.

Pregnancy two.

Genetic testing male.

I had never known.

Luke gave pink necklace and called her Rose.

I could not keep Rose.

I chose Daniel.

Not because anyone told me.

Pregnancy three.

Male.

Luke admitted putting substance in supplements.

I named Samuel.

Pregnancy four.

Male.

Court found Luke materially caused loss.

I named Noah.

Then Emma.

Alive.

A girl.

Not failure.

Not leverage.

My therapist Leah asked:

“Why names now?”

“Because Luke named story.”

I wanted mine.

Then I made small box.

Ultrasound images.

Hospital bracelets.

No pink necklaces.

I did not need jewelry.

I donated silver after police released.

Some people might call dramatic.

It was private.

Then first two.

Could they have been natural?

Yes.

I struggled.

If Luke did not cause Daniel, why did he lie about sex?

Control.

If he did cause, no proof.

I stopped trying to convict him in my head.

The court had resolved what it could.

Then Emma at two.

She loved board books.

She had no chronic complications from prematurity except mild early motor delay resolved with therapy.

No permanent harm.

That mattered.

My burns left scars and nerve sensitivity.

One additional revision surgery.

Then work.

I returned to library part time when Emma was eighteen months.

Children asked about scars.

I wore long sleeves at first.

Then stopped.

If child asked:

“I got burned.”

No story.

Then Rebecca.

Our relationship rebuilt slowly.

Not instantly.

I resented her sometimes for seeing warning earlier.

She resented me? She never said, but frustration.

One night:

“Why didn't you break door down?”

She stared.

“I couldn't.”

“I know.”

“Do you?”

I cried.

“I wanted you to save me without me choosing.”

She came closer.

“I wanted that too.”

Then:

“But if I had forced, maybe you would've defended him.”

Probably.

We had to mourn years separately.

Then Carol Mercer.

She continued seeing Emma supervised.

After Luke conviction, she wrote him:

I love you. I believe verdict.

He stopped responding six months.

Then resumed.

Complicated.

She did not ask me to forgive.

Good.

Then Mason.

I eventually allowed him one visit at Carol’s request.

He apologized.

“I carried bag.”

“You didn't know.”

“I didn't ask.”

Both.

He never defended Luke afterward.

Then Eric.

Tax case resolved.

He moved.

No ongoing.

Then financial restitution.

Luke’s business properties sold under divorce/receiver.

After mortgages, taxes:

Net equity $365,000.

My civil/trust claim:

$270,000 paid.

Remaining to Luke marital share/creditors.

House sale:

I received $72,000 after split and adjustments.

Insurance covered medical partly.

Criminal restitution ordered for my out-of-pocket and some trust losses not already recovered, avoiding double payment.

Over years, prison wages negligible, but asset forfeiture/settlement covered most.

No magic.

Then inheritance.

I had about $520,000 between restored funds and investments.

Emma trust $160,000 growing.

I was financially secure.

Not rich.

I still worked.

Then parental rights.

At age three, family court held hearing.

Luke participated by video.

Guardian recommended termination based on severe abuse directed at me during pregnancy, intentional poisoning affecting pregnancies, threat to finish me, long incarceration, and lack safe parental relationship.

Luke opposed initially.

He asked for letters.

The judge terminated his legal parental rights after evidence and best interest findings? In some states termination typically linked to adoption. Ohio can terminate in dependency case granting permanent custody, but here mother sole custody. Voluntary relinquishment easier. Maybe Luke eventually consented to permanent no-contact and sole custody rather than termination. Let's avoid questionable termination.

Court granted me sole legal and physical custody, suspended all contact indefinitely, and required Luke to petition with risk evaluation after release if ever. He remained legal father for support obligations.

Emma kept surname Mercer initially.

I considered change.

At five, after school, she asked:

“Why my name different from yours?”

I explained.

“Your dad's last name.”

“Can I have yours?”

That started legal name change process.

Luke objected from prison.

Then withdrew.

May you like

Emma became Emma Foster.

That felt complete.
