Chapter 9 - The Meeting Dimitri Wanted
Dimitri Volkov requested a sit-down.
Through lawyers.
That almost made Adrian laugh.
No warehouse.
No back room.
No armed table.
His attorney conveyed:
Volkov wanted to discuss “mutual de-escalation” before federal charges expanded.
AUSA Miriam Cole’s answer:
“No.”
Adrian:
“Can we record?”
“You are not arranging independent contact.”
“He might confess.”
“He might kill you.”
“Less likely in lawyer office.”
Miriam stared.
“Your cardiologist and I apparently share a professional challenge.”
“What?”
“You mistake surviving bad ideas for proof they were good.”
No meeting.
Instead federal investigators sought court authorization for monitored communications through cooperating intermediaries.
Adrian was not briefed on tactical details beyond what necessary.
Good.
He did not need to run operation.
Then Sarah.
Lily’s contact continued by video and supervised outings.
No secret location.
Once threat level lowered enough, Sarah returned to apartment with upgraded lawful security arranged through independent firm, not Moretti people.
Adrian offered to pay.
Sarah allowed part through formal child support/safety expense after court approval.
No hidden strings.
At playground, Lily ran toward him.
Stopped inches away.
“Can I hug?”
Adrian’s throat closed.
“Yes.”
She wrapped arms around waist carefully because shoulder.
He held.
First hug.
Sarah looked away.
Afterward Lily asked:
“Why do you have guards?”
Adrian answered:
“Some people are angry with me.”
“Because you did bad choices?”
“Yes.”
“Did you say sorry?”
“Some things need more than sorry.”
Sarah looked at him.
Good.
Then Lily:
“Mom says you might go somewhere.”
Adrian sat on bench.
“I may have to go to prison.”
Lily frowned.
“What’s prison?”
“A place people can be sent after they break serious laws.”
“You?”
“Yes.”
“Did you hurt someone?”
Adrian chose words with therapist.
“I helped run businesses that broke laws and used fear against people. Some people were hurt because of choices I approved.”
Lily’s eyes filled.
“Are you bad?”
“No easy answer.
“I did bad things.”
“Are you doing them now?”
“No.”
“Why?”
“Because I’m stopping.”
“Because me?”
Adrian looked at Sarah.
“Partly because meeting you made me stop lying to myself. But stopping is my responsibility, not yours.”
Sarah’s expression softened.
Important.
Child not responsible for redemption.
Then Lily picked flower.
“Prison long?”
“I don’t know.”
“Can I visit?”
“If your mom, therapist, and you think it’s good.”
“Can I draw?”
“Yes.”
That hurt most.
Then Volkov investigation.
Anton Volkov, Dimitri’s nephew, agreed to cooperate after prosecutors showed surveillance evidence.
He admitted:
Dimitri ordered him to confirm Lily existed.
No contact with child unless Dimitri later authorized.
Goal: leverage Adrian into surrendering Red Hook freight influence and a copy of financial records Volkov believed Adrian held.
He denied intent to harm Lily.
Messages supported:
“Keep girl clean.”
“Only pressure.”
No order to hurt.
Still kidnapping conspiracy when plan contemplated taking her temporarily.
Then Malenkov.
Shooter linked to Mulberry attack.
He admitted Volkov lieutenant paid him to shoot Adrian.
Was intent kill?
He was told:
“Put him down.”
Ambiguous.
But firing into Adrian’s vehicle at close range supported attempted murder.
Malenkov pleaded attempted murder/conspiracy and firearm counts, cooperated against Dimitri.
Then wire evidence.
Dimitri to lieutenant:
If Moretti won’t trade paper, we take what he hides.
Lieutenant:
Girl?
Dimitri:
The one thing he can’t replace.
There.
No need embellish.
Then federal grand jury indicted Dimitri Volkov on:
Racketeering conspiracy.
Conspiracy to kidnap Lily Caldwell.
Attempted extortion.
Attempted murder of Adrian Moretti.
Illegal gambling.
Money laundering.
Related counts.
Dimitri arrested at his New Jersey residence.
No shootout.
He surrendered.
Newspapers exploded.
MOB WAR ENDS IN CHILD KIDNAP PLOT
Not accurate that war ended.
But charges changed landscape.
Then Adrian.
Now useful witness.
Also target defendant.
Miriam Cole presented plea framework.
Racketeering conspiracy.
Illegal gambling.
Extortion conspiracy.
Receipt of stolen property/cargo-related count.
Tax? His taxes on illicit income may be not all reported. Could include tax offense. Better one count tax evasion.
Government would consider cooperation motion.
Forfeiture:
Illicit cash.
Two warehouse interests tied to racketeering.
Harbor Line accounts.
Certain nightclub interests.
Legitimate Moretti Maritime clean portion subject forensic tracing.
No promise keep empire.
Sentencing guideline initially severe.
Possible recommendation:
Seven to nine years depending cooperation.
Adrian’s face stayed still.
Sarah’s voice in his memory:
You finally meet her and disappear again.
“How long active?”
Miriam:
“Judge decides.”
“What does government expect to recommend?”
“If cooperation continues, likely around seven years.”
Adrian’s chest tightened.
Lily would be ten when he came out.
Maybe nine with credits.
He had met her at three.
He looked at DeLuca.
“Can we do better?”
“Maybe after Volkov trial.”
Miriam:
“Do not bargain with testimony quality.”
“I’m asking.”
“I know.”
Then she added:
“Your health will be documented for Bureau of Prisons. It does not erase sentence.”
Good.
Adrian:
“I’ll plead.”
DeLuca:
“We review first.”
“I know.”
Miriam almost smiled.
Then his phone buzzed.
Sarah.
Lily had drawn another picture.
This time:
A house.
Sarah.
Lily.
Adrian.
All with faces.
Above Adrian:
A rectangle.
Bars.
