Attempted obtaining property by false pretenses.
Guilty.
Attempted bank fraud related counts.
Guilty.
Conspiracy with Ron, Linda, and Melissa.
Guilty.
False adult protective report.
Guilty.
Attempted coercion.
Guilty.
One charge alleging completed theft of the $640,000?
Not guilty.
No funds disbursed.
That distinction mattered.
One count involving Claire’s joint brokerage transfer as criminal theft?
Not guilty.
Derek had transaction authority on the joint account.
That belonged largely in divorce accounting.
Again.
Accuracy.
Claire cried.
Not relief.
Grief.
A marriage can die long before a verdict and still hurt when a jury confirms why.
Then sentencing.
Melissa first.

I liked that.

Then:

Not nothing.
Less than Ron because of cooperation and lesser planning role.
Then Ron.
He spoke.
“I blamed Derek.”
Then:
“Derek lied to us.”
True.
“But I knew Tom did not sign.”
Also true.
“I shoved him because I thought if he got inside the cabin, we lost leverage.”
There.
He received thirty two months active custody, supervision, restitution, and a no contact order regarding me unless I consented.
Then Derek.
Claire made a victim statement.
Not vindictive.
“You did not only forge paper.”
She looked at him.
“You made me doubt my father.”
Then:
“You used my mother’s death, my passwords, my marriage, and my future inheritance as business tools.”
Derek cried.
Then my statement.
“I was always going to leave the cabin to Claire.”
The room became quiet.
“That fact does not reduce what happened.”
Then:
“It proves the point.”
I looked at Derek.
“If you had waited for the person who owned something to choose, none of us would be here.”
Then:
“You treated eventual inheritance as present permission.”
I sat.
Derek spoke.
For first time, no business explanation first.
“I forged it.”
Then:
“I thought if I saved the company, everyone would forgive the method.”
He cried.
“My parents would get their money.”
“Claire would get the cabin.”
“Tom would see it worked.”
Then:
“I was wrong.”
The judge considered no prior convictions.
Large planned fraud.
Multiple identities.
Dead woman’s signature.
Attempted bank loss.
False capacity report.
Coercion.
Derek received seven years active incarceration followed by supervised release and restitution obligations for verified fraud losses, with financial restrictions during supervision.
Not life.
Serious.
He would serve according to lawful credits and review rules.
Mercer Shoreline entered liquidation.
Ron and Linda’s $318,000 investment largely disappeared.
They recovered a small distribution from remaining assets.
Claire’s $145,000 joint brokerage transfer became a major issue in divorce.

Then the cabin title.

County records corrected.

No bank lien.
No occupancy claim.
No Mercer right.

Not to a secret nobody knew.
