Chapter 4 - Jessica Custody

The folder was nearly two inches thick.

My mother had been collecting material for seven months.

Some of it was harmless.

Olivia’s school calendar.

Pediatrician information.

Emergency contacts.

Then it changed.

Photographs of Jessica sleeping on the sofa.

Jessica crying in the kitchen.

Jessica sitting on the floor after a migraine.

Jessica with an unwashed laundry basket behind her.

Captions handwritten by Carmen:

Sleeps during day.

Emotional instability.

Unable to maintain house.

Leaves chores unfinished.

Then screenshots.

Messages between Jessica and me.

Jessica:

I can’t do everything alone when you travel.

Me:

I know. We’ll figure it out.

Carmen had printed only Jessica’s line.

Not mine.

Another:

Jessica:

I feel like I’m losing my mind in this apartment.

She sent that after Carmen invited twelve people over without warning.

The next message, omitted:

Me:

Mom needs to stop doing that. I’ll talk to her.

Carmen preserved the first line.

Discarded context.

Then school records.

An incident where Olivia arrived late twice in one week.

I had been away.

Carmen had promised to drive her.

She deliberately left late?

We did not know yet.

Then two anonymous child welfare intake reports.

I stared.

I had never heard about them.

Jessica had.

“Why didn’t you tell me?”

She looked at me.

“I did.”

Again.

My stomach dropped.

I remembered a call in March.

Jessica said:

“Someone reported me.”

I was rushing to board a flight.

Carmen was in the room.

She said:

“It’s probably some neighbor. Jessica yelled at Olivia in parking lot.”

I told Jessica:

“If you didn’t do anything wrong, it’ll close.”

Then I boarded.

It did close.

The report claimed Jessica left Olivia unsupervised for hours.

False.

A second claimed Jessica denied Olivia food.

The irony made me sick.

The person actually withholding food had been building a record accusing Jessica.

Investigators traced the second online report to a device connected to our home internet.

Not proof yet of who typed.

But Carmen’s tablet had been seized.

Then draft petition.

It was not filed.

Prepared from an online legal template.

REQUEST FOR TEMPORARY GRANDPARENT CARE.

The legal theory was weak.

Grandparents do not simply take custody because they dislike parenting.

But Carmen seemed to believe accumulation of allegations plus my travel schedule could create enough fear to pressure Jessica.

Then a second draft.

A letter for me.

Zayden,

Jessica has become unstable. I know you don’t want to believe it. I have protected Olivia while you’re away. You need to make decisions before something happens.

It was dated but unsent.

The date:

Next Monday.

The same day the loan rate lock expired.

My mother had planned a coordinated ultimatum.

Either Jessica signed the refinance and accepted Carmen’s control, or Carmen would begin telling me Jessica was unfit.

Maybe she expected me to believe her.

The worst part was, months earlier, I might have.

Then the loan package.

$620,000.

Purpose described as:

Debt consolidation and purchase of replacement residence for dependent family member.

Dependent family member:

Carmen Ferris.

Replacement residence.

My mother wanted to buy a home.

Jessica’s apartment would finance it.

Then property brochure.

SONORAN PALMS RESIDENCES.

A gated 55 plus community in Scottsdale.

Unit 18C.

Purchase price:

$389,000.

A handwritten note:

Closing Monday if funds verified.

My mother had already chosen her new home.

Then bank statements showed earnest money.

$25,000.

Paid from an account in Jessica’s name.

Jessica stared.

“I didn’t send that.”

Detective Morales said:

“The account was opened online four months ago.”

“By who?”

“In your name.”

Jessica’s face drained.

The address on file was our apartment.

Email:

Not hers.

Phone:

Prepaid number.

Deposits:

Several transfers from newly opened credit accounts also in Jessica’s name.

Identity theft.

Carmen had created debt in Jessica’s name, then planned to refinance Jessica’s apartment to clear it and buy herself a condo.

The custody folder was leverage.

Then Detective Morales said:

“We also found a notary appointment card.”

Friday.

Tonight.

8:30 p.m.

Notary:

Denise Wallace.

I looked at the guest list.

Denise Wallace was one of the women eating in our living room.
