Chapter 14 - The Custody Case They Never Filed

Jeffrey had retained a divorce lawyer five months before I came home.

That did not make him criminal.

People prepare.

The lawyer’s records, produced under appropriate discovery limits, showed Jeffrey initially asked about a negotiated separation.

Then custody.

He wanted primary physical custody.

Why?

He told the lawyer:

“Madeline lives overseas.”

The lawyer asked:

“Permanently?”

“No.”

“When does she return?”

“About five months.”

Then:

“Is she planning to move back?”

“Yes.”

The lawyer wrote:

Then her temporary work assignment alone is unlikely to establish abandonment.

Good.

Then Jeffrey described Liam’s “severe problems.”

The lawyer asked for evaluations.

Jeffrey supplied Dr. Lang’s first report.

The lawyer read it.

“This does not say severe.”

Jeffrey never returned.

No secret petition.

No judge deceived.

Again, controls.

Then the draft settlement he made privately with Cynthia and Noelle.

Madeline keeps London equity position in exchange for waiving domestic control.

Jeffrey keeps CEO role.

Joint house sold or Jeffrey buys Madeline out.

Liam primarily with Jeffrey during school year.

Madeline extended summer time.

None of it binding.

They had planned my life before speaking to me.

Then a note from Jeffrey:

If she fights, remind her how this looks: two years away, Liam unstable, affair public.

He intended to use his own affair against me.

Public humiliation as leverage.

Then:

If necessary, show London transfer already agreed.

The forged consent.

Create inevitability.

Then:

Once she sees board is with me, she settles.

The board was not with him.

That was his miscalculation.

Then family court.

I filed for emergency temporary custody after Liam’s hospital assessment and forensic interview.

Jeffrey opposed sole legal custody.

He wanted supervised contact immediately.

The judge reviewed evidence.

Temporary order:

Liam with me.

Jeffrey no unsupervised contact pending further evaluation.

Professionally supervised visits permitted if Liam’s therapist supported.

Noelle no contact.

Cynthia no contact.

No discussion of litigation with Liam.

No using Austin or other children as messengers.

No final termination.

Structure.

Then our mansion.

Joint marital property.

I sought temporary exclusive use because Liam’s therapist believed returning to a house with Jeffrey present would be destabilizing.

Jeffrey agreed to move to a corporate apartment rather than fight emergency occupancy.

Maybe advice.

Maybe guilt.

Either way.

I returned home with Liam six weeks after arriving from London.

He stopped at the dining room.

I held my breath.

He looked under the table.

Then asked:

“Can we throw it away?”

“The table?”

He nodded.

I almost said yes.

Then stopped.

“No.”

His face changed.

“We can if you want later. But they don’t get to decide what furniture scares us forever.”

He stared.

Then slowly climbed onto a chair.

“Can I sit?”

I nearly cried.

“Yes.”

He ate grilled cheese at the table.

Halfway through, he dropped a piece on the floor.

His whole body froze.

I picked it up.

Threw it away.

Got another.

No lecture.

No punishment.

He watched me.

Then whispered:

“Grandma says food costs money.”

“It does.”

“Was I bad?”

“No.”

That was the real custody case.
