Chapter 15 - Marcus Testifies Against His Mother

Marcus walked to witness stand looking older.

Plea agreement disclosed.

Defense would attack.

Prosecutor asked:

“Are you hoping for lower sentence?”

“Yes.”

Good.

“Could agreement be revoked if you lie?”

“Yes.”

Then relationship.

Vivian was his mother.

Richard stepfather.

Marcus joined Hale.

Promotions.

He admitted some he earned, some family.

Then accident.

At first he helped.

Drove Dad to appointments.

Handled vendor calls.

Then Vivian found chance.

“She said Richard had already cheated Caroline Trust, so nobody could accuse us without exposing him.”

Then:

“Did she call that leverage?”

“Yes.”

“Did you use it?”

“Yes.”

Then medication.

“I saw her give him extra pill once before notary.”

“What did you do?”

“Nothing.”

Then Helen refused.

Vivian furious.

Marcus copied seal.

“Why?”

“My mom told me we needed packet complete.”

“Did you know illegal?”

“Yes.”

Then copied signatures.

He inserted two.

Others Dad signed.

Then contact.

Changed Isabella to Vivian’s second number.

Then Dad called.

Vivian answered pretending? Did she pretend to be Isabella? Earlier Marissa dialed and heard Vivian, then Vivian later told Dad Isabella said not call. She didn't pretend voice. Good.

Marcus admitted telling Dad:

“She doesn’t want to talk.”

False.

Then money.

He spent.

He knew by second month Dad objected.

Still.

Then watch.

He took.

“Why wear?”

“Because I was angry at Isabella.”

She hadn't come yet when he took? He wore when she arrived. Maybe took earlier as symbol. He said his mother said Isabella not family and he would be heir. Fine.

Then defense cross.

“You forged documents.”

“Yes.”

“You stole.”

“Yes.”

“You want lower sentence.”

“Yes.”

“You blame your mother.”

“I blame both.”

Good.

Then:

“Richard taught you signatures could be copied, didn’t he?”

“No.”

“You saw his old forged amendment.”

“Yes.”

“And thought family did business this way.”

Marcus paused.

“I thought if he got away with it, maybe this wasn’t as serious.”

That was honest and ugly.

Then:

“Your mother told you Richard wanted transfers.”

“Yes.”

“So you believed?”

“At first.”

“Then when?”

“When Richard begged me to call Isabella.”

Then:

“You continued because?”

“I wanted money.”

There.

No blaming mom.

The jury noticed.

Then defense tried break audio.

Marcus authenticated.

No.

Then sentencing exposure.

He would likely get around four years.

Could prosecutor promise?

No.

Judge.

Good.

Then closing.

Prosecution did not call Vivian monster.

They said:

“Care does not create title.”

Then:

“Richard Hale’s old crime does not license a new one.”

Strong.

“His shame made him vulnerable. It did not transfer ownership to Vivian.”

Defense:

Richard had history of forging documents.

Marcus lied for plea.

Isabella stood to gain millions.

Vivian was spouse and caregiver.

Some signatures genuine.

Government turned messy family estate dispute into crime.

Then:

“No one can prove every transfer was unwanted at exact moment.”

True.

But charges tied specific documents.

Then jury.

Two days.

They asked for Marcus recording.

Asked definition exploitation.

Asked whether intent to permanently deprive required on theft count.

Judge answered law.

Then verdict.

Vivian stood.

Count one:

Guilty financial exploitation of elderly or disabled adult.

Count two:

Guilty conspiracy involving forged trust instrument.

Count three:

Guilty use of forged notarization.

Count four:

Guilty evidence or record tampering related to document presentation.

Count five:

Not guilty on one broader theft theory involving all VHM payments because some services and initial authority created reasonable doubt over full amount.

Good.

Count six:

Guilty on narrower theft count tied personal transfer used for Scottsdale deposit.

Simple assault of Richard:

Guilty misdemeanor based on recorded physical intimidation/contact? We can say guilty on lesser harassment/assault count.

Mixed.

Truth.

Vivian cried.

Dad closed eyes.

I felt relief and grief.

Then judge remanded.

No applause.

Outside, I saw red shoes in my memory.

But more than that, I saw Caroline’s handwriting.

Guardrails.

Finally restored.

Then one legal issue remained.

How much of Richard’s own wrongdoing would be made public in Vivian’s sentencing and the company’s annual report?

Dad had a choice.

He could let lawyers call it ancient technical defect.
