Chapter 14 - Vivian Takes the Stand
Vivian looked immaculate.
Cream suit.
Pearls.
No red heels.
Her attorney began with marriage.
She met Dad at charity dinner five years after Caroline’s death? Wait Vivian married 4 years ago, Isabella left 6. Let's say they met five years ago and married four. Fine.
Richard was lonely.
Isabella gone.
Marcus father died earlier.
Two families combined.
She cared.
Photos.
Trips.
Thanksgiving.
Dad smiling.
No lie.
Then accident.
Vivian slept hospital chair.
Managed specialists.
Built ramps.
She did real care.
Then attorney asked:
“Did you love Richard?”
“Yes.”
“Do you?”
She cried.
“Yes.”
Then finances.
Richard had discussed changing estate.
He said Isabella abandoned him.
He wanted Marcus recognized.
Some truth.
Did he authorize VHM transfers?
“Yes.”
Did he want Marcus company leadership?
“Yes.”
Did he sign?
“Yes.”
Then notary.
Vivian blamed Marcus.
“I did not know he copied seal.”
Marcus looked from witness area? He wasn't in courtroom except when testifying later. Fine.
Then medication.
“I asked nurse to increase dose because Richard was in pain.”
“Did you intend impair?”
“No.”
“Why mention notary?”
“I wanted him comfortable.”
Then contact alteration.
“Richard asked me to block Isabella.”
Dad stared.
Prosecution would challenge.
Then Caroline forgery.
Vivian said Richard confessed old fraud voluntarily during marriage.
“I was horrified.”
“Did you blackmail?”
“No.”
“I told him if he continued pretending he was morally superior, Isabella deserved truth.”
A clever reframing.
Then:
“Did you threaten to expose if he refused financial transfers?”
“No.”
Then control list.
“Marcus wrote.”
Then AFTER RICHARD spreadsheet.
“Estate planning.”
Then VHM.
“Investment.”
Then house.
“Richard promised mansion.”
No written premarital gift.
Then why deed after accident?
“He wanted security.”
Then prosecution cross.
“Mrs. Hale, did Richard’s valid prenup provide you approximately two million dollars in assets plus spousal rights if he died?”
“Yes.”
“So you were not going to be homeless.”
“No.”
“Did Caroline Trust benefit Isabella?”
“Yes.”
“Did that anger you?”
“No.”
Then email:
I’m done letting other people decide.
Vivian:
“I meant financially.”
Then Marcus recording.
“If Richard gets clear before close, use Caroline paper.”
Prosecutor:
“What does use Caroline paper mean?”
“Remind him of hypocrisy.”
“Threaten exposure?”
“No.”
Then:
“He will sign because he has more to lose than we do.”
Vivian’s face tightened.
“I was angry.”
Then Marissa recording.
“Double his dose before notary.”
“I asked for pain relief.”
“Doctor order said one.”
“I did not know.”
“Marissa told you.”
Silence.
Then:
“You said leave pills and I’ll do it myself.”
“Yes.”
“Did you administer an extra dose?”
Vivian hesitated.
“Once.”
There.
“Did physician authorize?”
“No.”
“Was it before notary?”
“Yes.”
Then:
“Did notary refuse because Richard appeared impaired?”
“I disagreed.”
“Did you later use a document bearing that notary’s forged seal?”
“I did not create seal.”
“Did you know Helen refused?”
“Yes.”
“Did you present document as valid later?”
A pause.
“Yes.”
That hurt.
Then:
“Did you alter Isabella contact?”
“Marcus did.”
“Did you know?”
“Yes.”
“Why?”
“Richard was emotionally unstable about her.”
Then:
“Did you tell Richard Isabella said not to call?”
Vivian looked down.
“Yes.”
“Had Isabella said that?”
“No.”
There.
Then financial transfers.
“Did Richard authorize six hundred forty thousand to VHM?”
“He knew generally.”
“Did he sign transfer instructions?”
“Some.”
“Did you spend funds on Scottsdale deposit?”
“Yes.”
“Was property titled to Richard?”
“No.”
“VHM?”
“Yes.”
“Who owned VHM?”
“Marcus and me.”
Then mansion wire.
“Did Richard owe VHM nine hundred fifty thousand?”
“No.”
“What was mansion equity reimbursement?”
Vivian hesitated.
“I believed I deserved equity for caregiving.”
No contract.
Then the heel.
I had witnessed Vivian put foot near Dad, shove shoulder.
She called it helping him sit.
Foyer security camera had captured? Mansion had security? We can have interior system, Isabella came with video? User prompt says no explicit but plausible. The camera showed foot. Not enough for serious assault, but humiliation.
Prosecutor:
“Did you call him useless old man?”
Vivian closed eyes.
“Yes.”
“Did you threaten medicine?”
“I was frustrated.”
Then final:
“Mrs. Hale, when Richard could no longer sign clearly, what did you do?”
Defense objected argumentative.
Sustained.
Prosecutor rephrased:
“After Helen Park refused notarization, did you stop using the document?”
“No.”
“After Richard asked for Isabella, did you connect them?”
“No.”
“After he questioned transfers, did you return funds?”
“No.”
“After he became clearer, did you tell him his original trust authority was likely forged?”
“No.”
Then:
“Why?”
Vivian looked toward Dad.
And said:
“Because after years of taking care of him, I was not going to let that girl walk back in and take everything.”
The courtroom went silent.
