Chapter 12 - My Family’s Favorite Word

“Overreacting.”

That was the word my family used for me.

I overreacted when Vanessa broke lamp.

Overreacted when she shoved me at Christmas.

Overreacted when Ruby’s bruise did not make sense.

Overreacted when I called 911.

The defense attorney used a nicer version.

“Would you describe yourself as protective?”

“Yes.”

“Extremely protective?”

“Yes.”

“Some relatives call you anxious about Ruby.”

“Probably.”

“Did you sometimes limit what she ate?”

“Allergies? No. Sugar? Normal.”

“Did you ever accuse Vanessa before?”

“Yes.”

“Of what?”

“Being rough.”

“So longstanding conflict.”

“Yes.”

Then:

“Do you dislike sister?”

“Yes.”

The jury looked.

“Did you dislike her before assault?”

“Yes.”

“Why?”

“She had hurt me, screamed at people, and I didn't trust her temper.”

Then:

“Yet you still brought Ruby.”

The question pierced.

“Yes.”

“Why?”

“Because I trusted parents to supervise.”

“So you knew Vanessa risky enough to require supervision?”

“I knew she could yell. I did not know parents were hiding physical incidents.”

Then:

“Ruby had bruise from prior visit. You accepted swing explanation.”

“Yes.”

“So you can be mistaken about how injury happened.”

“Yes.”

No hiding.

Then:

“Could you be mistaken about table?”

“No.”

“Why?”

“I watched her hand in my daughter's hair.”

“And video.”

“Yes.”

Then the hospital.

Texts.

Parents holding.

Then bottle toss.

“Did Vanessa throw water bottle at you?”

“Yes, after I told her stay away.”

“Did it hit?”

“My shoulder.”

“Any injury?”

“No.”

“Could it have been frustration rather than attempt harm?”

“Yes.”

Fair.

Then defense:

“Did you lunge toward Vanessa at hospital?”

“Yes.”

“Would you have hit her?”

“I don't know.”

Grandfather held me in video prompt. In story at hospital Dad grabbed arms. Could be.

“So you were violent too.”

“I was trying to reach sister after my daughter was assaulted.”

“Answer.”

“I lunged.”

Then:

“Did father restrain you to prevent fight?”

“At hospital, yes. At house he also held me while daughter was unconscious.”

Different.

Then:

“Could his intent at house also be stopping fight?”

“He said I was making worse.”

Maybe.

I could not read mind.

Then prosecutor redirect:

“Did holding prevent you from reaching injured child?”

“Yes.”

“Did parents attend to Ruby?”

“No. Mom went to Vanessa first.”

Then cloud.

Deletion.

Prior clips.

Then:

“Did you tell Ruby what happened before her forensic interview?”

“I asked one question in hospital and doctor stopped me.”

Good.

“After that?”

“No leading.”

Then:

“What do you want from jury?”

Objection maybe. The prosecutor rephrased:

“Why did you report?”

I looked at Vanessa.

“Because my daughter was hurt and my family wanted the truth erased.”

I stepped down.

Then Dr. Bennett.

He testified current injury consistent with high energy blunt impact, not a simple low chair fall.

Could he say mechanism video? He saw video? Maybe later. He didn't need.

Then Dr. Patel described permanent visual impairment.

“Will Ruby fully regain vision?”

“Unlikely.”

“What does she have?”

“Severely reduced acuity, limited field.”

Then defense:

“Could prompt treatment save more?”

“We treated promptly.”

“Would delay of minutes from family affect?”

“No evidence.”

Good. Grandparents not blamed for medical outcome beyond assault.

Then video expert.

Authenticity.

No editing.

Then cloud provider log.

Deletion attempts.

May you like

Then parents.

Dad testified first.
