Chapter 7 - The Charges

Vanessa was arrested first.
Not because she was woman who slapped Mom in viral scene.
The dinner video never became public.
We kept private.
Charges were based on evidence.
Assault and battery against an older adult.
Coercion connected to effort to obtain life-estate release.
Conspiracy to commit real-estate/lending fraud.
Use of forged property instrument.
Related elder-financial coercion.
Some counts later merged.
No attempted murder.
No kidnapping.
Brandon surrendered next morning.
His charges:
Fraud conspiracy.
Use of false instrument.
Fiduciary misuse related to Mom.
Coercion-related participation.
He was not charged with hitting her.
Because he had not.
Paula faced false-notarization charge.
Then bail.
No contact.
No house.
No Mom.
Family called.
Aunt Carol:
“Claire, is Brandon really going to jail?”
“I don’t know.”
“You could tell prosecutor he didn’t hurt Helen.”
“I have.”
“So help.”
“I’m telling truth. That’s help.”
Another cousin:
“Vanessa manipulated him.”
“Evidence says house idea started with him.”
Silence.
Then Mom.
“He’s my son.”
Every day.
“I know.”
“Can I write?”
We asked victim advocate.
Allowed through counsel if she chose.
She did.
Brandon’s first letter came a week later.
Mom, I knew Vanessa was treating you badly.
Mom stopped.
Then continued.
I kept telling myself once BVM stabilized, she would calm down.
Then:
I told myself Claire would have helped if she understood how bad things were.
He never asked.
Then:
I told myself using the house temporarily was not stealing because Claire would get it back.
Then:
I told myself asking you repeatedly was not coercion because you could still say no.
Mom cried.
Then:
But every time you said no, I made your life harder by staying silent when Vanessa punished you for it.
That sentence.
He finally saw.
Then:
I am sorry.
Mom folded.
“Do I forgive?”
“You decide.”
“I think yes.”
Already.
Then:
“But I don’t want him here.”
“That can also be true.”
She nodded.
Then Vanessa requested send letter.
Mom said no.
No guilt.
Then financial evidence deepened.
BVM had real business.
Six employees.
Real clients.
Revenue.
Not fake.
But overleveraged.
Debts due.
Loan would rescue.
And reimburse Brandon/Vanessa $118k.
That showed self-benefit.
Then earliest texts.
Four months before forged deed:
Brandon:
We’re out of collateral. Claire’s place is clear except Mom’s occupancy thing.
Vanessa:
Claire will never sign.
Brandon:
If she deeded temporarily, we could save company.
Vanessa:
Ask.
He never did.
Later:
Brandon:
What if we prep transfer and get Claire to ratify after?
Vanessa:
Now you’re thinking.
There.
No evil mastermind spouse.
My brother conceived shortcut.
His wife embraced.
Then prosecutor offered Brandon plea.
Full factual admission.
Restitution.
Cooperation.
No minimizing.
Recommended four-to-five years.
He hesitated.
Then Mom wrote:
Tell the truth even if truth costs you.
He accepted.
Vanessa did not.

She would go to trial.
And that meant my mother would have to say in court what she had spent two years hiding from everyone she loved.
