Vanessa rejected a plea offer that required her to admit elder abuse and financial exploitation.

She would admit “financial mistakes.”

Not abuse.

She claimed Dad had become difficult.

Violent.

Confused.

Her trial began ten months after the police station.

The prosecutor did not start with the bat.

She started with paperwork.

Smart.

First:

Valid limited POA.

Then expiration.

Then forged durable POA.

Copied signature.

Fake notary.

Then trust.

Old certificate.

Current amendment.

Messages proving Vanessa knew the newer trust existed.

Then Evercrest.

The $50,000 deposit.

LLC.

Money spent.

Then VJM Family Care.

Invoices.

No meaningful outside clients.

Then account transfers.

Credit card charges.

Then guardianship.

APS reports.

IP addresses.

Dr. Reeves.

His recommendation for further testing.

Vanessa’s request for stronger language rejected.

Then memory care paperwork.

The secret reservation.

Then physical abuse.

Dr. Sanderson testified about injuries.

Healing rib fracture.

Fresh bruising.

Older bruising.

Finger shaped marks.

No claim every bruise came from Vanessa.

Some could come from Daniel restraining Dad.

Accuracy strengthened the case.

Then Dr. Benson.

No dementia at relevant time.

Competent.

Then Dr. Reeves.

“Did you recommend guardianship?”

“No.”

“Did Mrs. Mercer ask you to describe Robert as dangerous?”

“Yes.”

“Did you have basis?”

“No.”

Then APS worker.

Reports filed.

No substantiated self neglect finding.

Then videos.

Keys.

Wallet.

Phone.

Dad being shoved into chair.

Then workshop audio.

Daniel retrieving bat.

Vanessa saying “hold him.”

Metal strike.

Dad screaming.

Then 911.

“I need documentation this time because court needs to know he’s dangerous.”

Then station footage.

Vanessa reaching for bat.

Swinging.

Screaming:

“Stay down, you crazy old bastard!”

No expert interpretation required.

Officer Davis testified.

Defense asked:

“Did Elena Hale’s federal background influence you?”

“Yes.”

The prosecutor looked up.

Davis continued.

“It influenced me to document more carefully after she asked. It did not cause Vanessa Mercer to swing a bat inside my station.”

Good.

Then me.

Defense tried:

“You dislike Vanessa.”

“Yes.”

“You want her convicted?”

“I want the jury to decide from evidence.”

“You shoved her.”

“After she swung a bat at my father.”

“You are trained in defensive tactics.”

“Formerly.”

“Could you have escalated?”

“I placed myself between a bat and a seventy year old man.”

Then Daniel.

He testified under his plea agreement.

Defense attacked his credibility.

“You stole from your father.”

“Yes.”

“You lied to police.”

“Yes.”

“You want sentence consideration.”

“Yes.”

“So why should jury believe you?”

Daniel looked at them.

“Don’t believe me because I’m good.”

Then:

“Believe the messages I wrote before I had anything to bargain with.”

That was strong.

Then he described bat night.

The finances.

Guardianship.

The plan to move Dad.

Defense asked:

“Did Vanessa force you to transfer money?”

“No.”

“Force you to lie?”

“No.”

“Force you to hold Robert?”

“No.”

He owned it.

That made him harder to dismiss.

Then Dad insisted on testifying.

I hated the idea.

He said:

“She has heard everyone else talk about me.”

Then:

May you like

“I want to speak for myself.”

So he did.
