Chapter 9 - The Photograph

I remembered the wrench.

Eventually.

Not all at once.

A flash.

My father’s old toolbox.

The railing wobbling.

Me telling Brent the contractor had left it unsafe.

I had gone upstairs to inspect.

That was why I was in the loft.

Not to retrieve drawings.

At least not only.

Memory is strange after trauma.

People imagine it returning like a movie.

Mine came as objects.

Wrench.

Dust.

A yellow extension cord.

Brent’s shoes.

I told Detective Hall.

She asked:

“Did you loosen anything?”

“No.”

“Are you sure?”

“Yes.”

“Did you attempt repair?”

“I tightened one bolt.”

“Could that affect failure?”

“I don’t know.”

Engineering expert reviewed photograph.

The railing defect was real.

One anchor plate was inadequately secured.

Even without force, leaning heavily could cause failure.

That made old assault case harder.

I was almost relieved.

Why?

Because certainty that my husband shoved me into paralysis was unbearable.

Then guilty for relief.

Dr. Greene said:

“You are allowed to prefer a world where that didn’t happen.”

But evidence kept moving.

Audio recording started:

11:08.

Fall:

approximately 11:14.

Why did Brent photograph railing?

His defense:

To document defect before contractor repair.

Reasonable.

Then why lie that he was not upstairs?

No reasonable answer.

Scott’s statement put him there.

Audio put him there.

He had grabbed me.

Then I fell.

Still not proof of push.

Prosecutor Dana Mercer told me:

“We may not charge old incident unless evidence strengthens.”

I nodded.

“Thank you.”

“For what?”

“Not using my anger as evidence.”

She held my gaze.

“That’s not my job.”

Good.

Meanwhile Allison faced her own consequences.

The county charged her with a misdemeanor tied to knowingly helping Brent deprive me of my wheelchair and participating in false affidavit submission? Filing false affidavit is serious maybe perjury. She signed under oath. Prosecutor negotiated based cooperation.

Her lawyer approached:

Allison would plead to a reduced offense related to false statement/assistance and cooperate fully.

Community supervision.

Fine.

Possibly short suspended jail.

I did not oppose.

I did not forgive.

Both possible.

Scott was not charged for failing to intervene eleven months ago or for signing an opinion-based affidavit that he later said he misunderstood.

Kevin’s case was worse.

Fake notary seal.

False witnessing.

Financial document.

He pleaded guilty to forgery/notarial fraud related offenses and agreed to testify.

He lost his job.

His sister Kelly lost nothing legally after proving stamp stolen.

She cried when she apologized to me.

“It was my seal.”

“Not your act.”

I meant it.

I had learned not to spread guilt by association.

Then the land option was declared unenforceable pending final civil ruling.

Midland Ridge withdrew from deal entirely.

They sued Brent for return of deposit.

Cedar Hollow remained mine.

I sat on the porch in my wheelchair two months after the party.

First time home.

The dirt in the yard had been reseeded.

I had asked groundskeeper to do it.

Not because erasing evidence.

Police released scene weeks earlier.

I did not want a permanent strip of bare earth memorializing what Brent did.

Allison’s key sat on table.

The utility cabinet had been rekeyed.

The fence camera still blinked.

I hated it.

Needed it.

Then Maya brought a box from police.

Property released from Brent’s office search.

Inside:

My old phone.

The one broken the night of fall.

Screen shattered.

I thought it had been disposed of.

Brent kept it.

Why?

Digital forensics had already imaged it.

Maya said:

“They found one unsent message.”

“To whom?”

“My sister?”

I had no sister. Hmm. Need choose recipient: to Maya? We had maybe known Maya before? Could have been to friend Laura. Better to myself? Let's make it a draft to Allison? Hmm. Rachel had maybe tried to text Scott? Let's introduce her late father's attorney? Instead, message drafted to Brent makes no sense. Let's say to my friend Megan Shaw, an old college friend. We can introduce lightly. But this late maybe okay. Yet user wants consistency. Maybe to Allison? She worked for Brent. Rachel may have messaged her for records.

Let's say unsent text to Allison:

I found the Midland option. Brent forged my signature. If anything happens tonight, please keep the office copies.

I stared at timestamp.

11:07 p.m.

One minute before the audio began.

I had known I was confronting him over forgery.

And before I did, I had tried to create a witness.

The message never sent because service in barn was poor.

But Brent kept the broken phone.

Why?

Maybe to prevent recovery.

Maybe sentimental.

Maybe forgot.

Forensic analyst found something else.

At 11:16, two minutes after my fall, Brent unlocked my phone.

Using my passcode.

Then deleted the draft.

The cloud retained it.
