Chapter 9 - Agnes’s Version
Agnes testified at her own trial.
Before that, prosecution built case.
Loan records.
Remote notary.
My forged signature.
Leo’s forged signature.
Chloe’s plea testimony.
Search evidence.
The skillet.
Hospital discharge.
Leo eyewitness.
Then the collapse video.
The judge allowed selected portions relevant to motive and state of mind, not simply to make Agnes look cruel.
Chloe testified first.
Agnes stared at her daughter.
Chloe cried.
“Mom told me Claire would say no if we asked.”
Defense:
“And you wanted the boutique.”
“Yes.”
“You forged.”
“Yes.”
“You impersonated Claire.”
“Yes.”
“So you are criminal.”
“Yes.”
“You want lower sentence.”
“I already got sentenced.”
That mattered.
Then:
“Isn’t blaming your mother easier?”
Chloe said:
“I wish she hadn’t helped.”
Then texts.
Agnes:
Find cabinet key.
Agnes:
Use paper copies.
Agnes:
Leo won’t come home.
Hard.
Then Leo.
He testified to his email.
Claire needs to learn family isn’t just about what belongs to whom.
Defense pounced.
“You believed Claire should help Chloe.”
“Yes.”
“You wanted the duplex considered.”
“Yes.”
“So your mother had reason to believe you supported financing.”
“No.”
“Why?”
“Because Claire said no.”
Then:
“Did you tell Agnes Claire said no?”
“Yes.”
Text from Leo:
She’s not putting duplex up. Drop it.
There.
Later complaint email still ugly, but no authorization.
Then assault.
“I watched my mother raise skillet.”
“Did she swing?”
“Not second time.”
“First throw?”
“I was in hallway and heard crash, then saw pan on floor and Claire against wall/table.”
So he did not see first throw from start perhaps. But he heard and arrived in time. Claire testimony plus Agnes admission she threw "to scare". Good.
Then me.
I described surgery.
Return.
Words.
Throw.
Shove.
Second raise.
No exaggeration.
Defense:
“You had decided to divorce before entering house.”
“Yes.”
“You hated Agnes.”
“I wanted away from her.”
“You had motive to accuse.”
“I reported what happened.”
Then financial.
“You refused to help Chloe.”
“Yes.”
“You called her lazy.”
“Yes.”
“Did that create hostility?”
“Yes.”
No saint.
Then:
“Did Leo ever discuss using duplex?”
“He said I could consider. I said no.”
Then:
“Were you angry about Leo’s email to Agnes?”
“Yes.”
“Could that make you want to destroy his family?”
“No.”
Then hospital collapse.
“You called 911 yourself.”
“Yes.”
“Agnes did not prevent.”
“No.”
“Then she did not cause delay.”
“She did not help.”
But legal focus not failure to aid.
Good.
Then Agnes.
Her version:
Claire disliked her from beginning.
Claire controlled Leo.
Claire refused reasonable family help.
Chloe’s boutique would have benefited everyone.
Claire “verbally agreed to think about” collateral.
Then surgery.
Agnes claimed she believed Claire had “a cyst,” not life-threatening condition.
Why?
Paramedics did not tell her diagnosis.
Hospital later called?
She admitted nurse said emergency surgery.
Then why no visit?
“She didn’t want me.”
Did I say?
No.
Then skillet.
Agnes admitted throwing.
“I was angry.”
“Toward Claire’s head?”
“No. Wall.”
But trajectory expert? We don't need. Photo shows strike 11 inches from where Claire stood. Hard to know.
Then:
“Why pick up second time?”
“I was moving it.”
Leo said raised.
Conflict.
Then financial.
“Did you hand Chloe documents?”
“Yes.”
“Why?”
“I believed Claire agreed.”
“Why disguise Chloe during notary?”
Agnes:
“That was Chloe’s idea.”
Chloe said Agnes found wig.
Then:
“Why have Claire’s deed in suitcase?”
“Safekeeping.”
“Why was cabinet pried?”
“Chloe.”
Then prosecutor asked:
“What did Claire say when you asked to use duplex?”
Agnes avoided.
Finally:
“She said no.”
The courtroom quieted.
Then:
“Did she ever later say yes?”
“No.”
There.
Everything else collapsed.
Then prosecutor played a text:
Agnes to Chloe:
She’ll never sign if we ask again. Do it while she’s gone.
No interpretation needed.
Then:
“Gone where?”
Agnes:
“Hospital.”
Then:
“You knew she had undergone emergency surgery.”
“Yes.”
Then:
“You used that time because she could not interfere.”
Agnes cried.
“I was trying to save Chloe’s future.”
“That was not the question.”
Then assault.
“Claire said she was leaving.”
“Yes.”
“You told her she wasn’t.”
“Yes.”
“Why?”
“Because families don’t walk out after one argument.”
“Then you threw cast iron skillet.”
“I lost my temper.”
Then:
“And raised it again.”
“I don’t remember.”
Leo remembered.
Then jury.
Deliberated twelve hours.
Verdicts:
Aggravated assault based on dangerous use of skillet: guilty.
Domestic violence related assault/battery for shove: guilty.
Attempted financial fraud conspiracy: guilty.
Forgery conspiracy/identity misuse: guilty.
Attempted fraudulent property transfer: guilty on narrower theory.
One count alleging Agnes personally impersonated me during notarization: not guilty, because Chloe did.
Accurate split.
Agnes sat motionless.
Then looked at Leo.
“You did this.”

For once he understood not every accusation deserved a response.
