Chapter 9 - Diane’s Version
Diane entered a formal proffer with prosecutors.
No immunity.
Her attorney sat beside.
Everything could potentially affect plea depending agreement.
She described party from beginning.
Frank had brought the beneficiary waiver.
He planned to pressure Ethan after cake.
When Ethan refused in study around 3:40, Frank became furious.
“Then Megan wins.”
Ethan said:
“This isn't about Megan.”
Frank:
“It is always about Megan.”
Diane heard.
Then Ethan left to find charger upstairs? Wait he later was at top landing. He left study, went upstairs for charger around 4:15, but somehow didn't encounter his parents? Need timeline: Ethan goes to second-floor office/third floor? Guest room is second. He might go to master office across hall then downstairs? We need avoid. Could say he went to third-floor den to get charger, leaving second-floor guest room unnoticed. Fine.
Diane said Frank told her:
“Go make sure Lily stays out of the family photograph.”
That sounds petty.
She went upstairs.
Lily asleep.
Diane pulled blanket.
Told her to wake.
Lily said no.
Diane took Clover.
Lily cried.
Then said:
“Daddy says I'm Bennett.”
Diane admitted:
“I slapped her.”
Once.
Then Lily shouted for me.
Frank entered.
He told Lily stop.
Lily tried to run.
Frank grabbed her arm.
She twisted.
He shoved.
Her face hit wooden bedframe.
Then Diane claimed she screamed at Frank:
“What did you do?”
Did audio capture? No.
Owen heard crying, not that phrase.
Could be self-serving.
Then Lily got quiet.
Diane panicked.
“Is she okay?”
Frank said:
“She’s being dramatic.”
They left.
That was horrifying.
They left injured child alone.
Then downstairs.
Frank made “worthless” comment.
Why?
Diane said because he was angry at me and Lily.
Then I came down.
Diane told me phone away.
Why?
“She would call police.”
Exactly.
Then the statement:
“Only my real grandchild matters.”
Why say?
“I meant trust.”
As if that helped.
Then prosecutor:
“Did you believe Lily deserved injury because she wasn't biological?”
“No.”
“Then why slap her?”
Diane cried.
“She was talking back.”
Six.
A sleeping six-year-old.
Then financial.
She admitted co-signing annual family certifications without reading trust.
But in second year, she knew Lily existed and knew Frank did not list.
“I believed him that adopted did not count.”
Then after bank email stating adopted descendants included? Investigators found Hawthorne sent annual summary with definition attached.
Did Diane read?
She opened email.
Attachment not opened according tracking? Could be. That helped.
False expense forms:
She knew guesthouse was not education.
She signed anyway.
Why?
“Frank said Margaret would have wanted family to use property.”
No evidence.
Then prosecutors asked about previous treatment of Lily.
Did she ever strike before?
“No.”
Any verbal abuse?
Diane admitted saying:
not blood.
not real Bennett.
Charity case.
Baggage? Maybe she told Ethan. She claimed not to Lily directly until party. But texts suggest.
Then why gifts difference?
“Madison is my granddaughter.”
“And Lily?”
Silence.
Then:
“Legally.”
There it was.
Even facing felony, she could not say family.
Then plea negotiation.
The prosecutor offered:
Plead guilty to felony assault/endangering child? Depending jurisdiction. Let's use broad "felony child assault and endangering the welfare of a child" without degree.
Admit one falsification offense related to trust.
Cooperate truthfully.
No contact with Lily.
Restitution.
Recommended sentence between two and four years.
Diane accepted eventually.
But before plea, Megan can give statement later.
Then Frank’s response.
He called Diane liar.
Claimed she hit Lily repeatedly and he only tried to intervene.
His lawyer said hall audio ambiguous.
The case split.
Then Lily.
We did not tell her details.
Only:
“Grandma and Grandpa are not allowed to see you.”
She asked:
“Forever?”
I said:
“You don't have to decide forever today.”
Good.
Then Diane requested to send apology through counsel.
I said no.
Lily was six.
She did not need adult remorse delivered like homework.
Then Ethan supported.
That surprised me.
“She doesn't get to make Lily comfort her.”
Good.
Then trust hearing.
Diane resigned.
Frank fought.
Court removed both.
The judge found:
Intentional failure to disclose eligible beneficiary and serious breaches of fiduciary duty.
The $96,400 surcharged jointly pending final apportionment.
Frank also lost authority over other family trusts? Only this trust perhaps.
Then corporate trustee Hawthorne accepted criticism for insufficient verification and paid part of legal expenses under settlement? Maybe bank wasn't fraudulent but control failure. It agreed to waive fees for two years and fund independent audit, not huge damages. Good.
Then Ethan received formal notice:
Lily Bennett recognized beneficiary effective adoption date.
He showed me.
I stared at Lily’s name.
Not because money.
Because the piece of paper Frank tried to erase now said:
BENEFICIARY.
But I did not show Lily.
