Chapter 15 - Ethan Takes the Stand
“State your relationship to defendant.”
“He is my father.”
“Relationship to Lily Bennett?”
“She is my daughter.”
Frank looked down.
Then adoption.
“I adopted Lily when she was four.”
“Why?”
“Because I had been raising her since she was one and wanted law to match our family.”
“Did you know about Margaret trust effect?”
“No.”
“When did you learn?”
“After Lily was hospitalized.”
Then texts.
Projected.
Diane:
She isn't your daughter because judge typed it.
Frank:
Adopted kids don't count.
Then:
If Lily stays listed as legal child, Madison loses half.
Sign beneficiary clarification before party ends.
Do not drag Megan into it.
Then deleted:
If you refuse, your mother will handle Lily herself Saturday. I’m tired of this.
The jury read.
Prosecutor:
“Why delete?”
“Because I didn't want Megan to see.”
“Why?”
“Because I knew she'd refuse party.”
“Why would she refuse?”
“Because my parents were hostile to Lily.”
There.
“Did you believe they would physically hurt her?”
“No.”
“Did you believe they might humiliate her?”
“Yes.”
I closed my eyes.
Ethan kept going.
“I was wrong to bring her.”
No objection.
Then study argument.
Frank gave waiver.
Ethan refused.
What did Frank say?
“You are choosing someone else's child over your blood.”
Ethan:
“She is my child.”
Frank:
“Not in this family.”
Then Ethan left.
Why not tell Megan?
“Ashamed. Scared of confrontation. I thought we could leave after cake.”
Then did you go upstairs?
Third-floor den.
He needed charger and space.
He did not know Diane went guest room.
Then heard Megan yelling.
Came to stairs.
Saw Lily.
“What did you think?”
“I thought my parents had done what I spent years telling myself they would never do.”
Silence.
Then defense.
Frank’s attorney approached.
“Mr. Bennett, you are separated from your wife because of your own conduct.”
“Yes.”
“You blame father for that?”
“No.”
“You don't?”
“I blame myself for what I hid.”
Then:
“You want reconcile.”
“Yes.”
“You know testifying against father helps you with Megan.”
Ethan paused.
“It may.”
“So motive.”
“I would testify same if Megan divorced me tomorrow.”
That hit.
Then:
“You deleted message. Could be because you thought father was exaggerating?”
“Yes.”
“So you did not interpret as physical threat.”
“No.”
“Then why should jury?”
“Because Lily was hurt after he sent it.”
Objection argumentative? The judge allowed limited? Maybe.
Then:
“Did you see father touch Lily?”
“No.”
“Did father ever hit you as child?”
“No.”
Interesting.
He had shouted/thrown, but not hit him. Diane slapped sometimes.
“Did you ever see father hurt child?”
“No.”
Then:
“So this was completely out of character?”
Ethan thought.
“No.”
The attorney frowned.
“You said no prior child violence.”
“Physical child violence, yes. But believing people deserved punishment for disobedience was not out of character.”
Strong.
Then trust.
“Did you accept gifts from father?”
“Yes.”
“Down payment?”
“Years before marriage, yes.”
“College?”
“Yes.”
“You benefited from family money.”
“Yes.”
“So now that money dispute hurts you, father suddenly criminal?”
“No. The trust records and assault made him defendant.”
Then defense tried Lily beneficiary.
Could Ethan and Megan benefit eventually?
Potentially Lily does, not them.
Carol controls.
Ethan cannot withdraw for himself.
Then:
“Would recognizing Lily reduce Madison’s share?”
“Potentially.”
“Does that benefit your household?”
“If Lily gets education support, yes.”
“Financial motive.”
Ethan said:
“I didn't know she qualified when Megan called 911.”
Again.
Then prosecutor redirect:
“When did Megan first accuse father?”
“Before anyone told us trust terms.”
Done.
Ethan stepped down.
Frank did not look.
Then outside courtroom, Ethan found me near elevator.
I said:
“You told truth.”
“Yes.”
“That doesn't fix us.”
“I know.”
I almost laughed.
Then:
“Stop saying it.”
He smiled weakly.
“I'm trying.”
That night Lily had school art show.
We both attended.
Her painting:
Two houses connected by a yellow bridge.
I asked:
“What is it?”
“Mine and Daddy’s.”
Then:
“Bridge means he can come.”
I looked at Ethan.
He cried in hallway.
Lily rolled eyes.
“Dad cries a lot now.”
Children.
Then Frank’s own testimony.
Against lawyer advice.
He believed he could explain.
He said:
Diane caused injury.
He entered to stop argument.
Lily ran.
He caught arm.
She twisted and hit bed.
Accident.
Then why initial denial entry?
“Panic.”
Why tell Ethan to lie?
“I didn't.”
Audio/text? His calls.
Why “worthless” comment?
He denied exact.
Several witnesses heard.
Then “not real grandchild.”
He said biological fact.
Then trust.
He believed mother intended blood descendants despite text.
Prosecutor displayed Margaret’s letter:
Any child my descendants choose through adoption is not lesser in my eyes or under this trust.
Frank read.
“Was that your mother's handwriting?”
“Yes.”
“Did you know?”
“Yes.”
The courtroom changed.
Then:
“Why exclude Lily?”
Frank:
“Because Ethan made mistake.”
“What mistake?”
“Adopting her.”
