Chapter 5 - Dead Before Midnight

Richard did not report us missing to police.

He called lawyers.

That told investigators exactly what mattered to him.

At 8:21, he emailed Claire Maddox, my mother’s estate attorney.

Subject:

URGENT BENEFICIARY ABANDONMENT.

Claire knew enough to be suspicious.

Ethan had already warned her we were alive.

She played along.

Richard wrote:

Melissa has left Colorado unexpectedly with Sophie after a serious family dispute. She took documents belonging to Evelyn’s estate and has indicated she wants no further involvement.

He attached my fake email.

Then asked Claire to recognize Daniel as temporary family representative.

Claire replied:

Melissa is named successor trustee under the amendment.

Richard:

The amendment is invalid.

Claire:

That has not been determined.

Then Daniel called.

Claire recorded with consent under applicable law? Colorado one party? We need not specify. She documented.

Daniel said:

“My sister is unstable.”

Then:

“She’s been threatening to disappear for months.”

False.

Then:

“She took Sophie without telling anybody.”

I was Sophie’s mother.

I did not need my brother’s permission.

Then he said:

“We’re worried she may hurt herself.”

There.

They were building more than abandonment.

If my car was found at airport and I vanished, later they could suggest suicide or voluntary disappearance.

Then Claire asked:

“Why are you calling before police?”

Silence.

Daniel:

“We’re trying not to embarrass the family.”

Of course.

Then at 9:10, Richard contacted the bank holding Box 214.

He claimed Evelyn’s estate needed emergency access because “Melissa stole the only trust copy.”

The bank refused without court authority.

Then he called an attorney friend.

Asked how quickly a court could remove an absent trustee.

The answer:

Not overnight.

Richard became angry.

Then investigators monitored financial activity under warrants.

At 10:37, Daniel logged into Silver Peak Holdings.

Uploaded a draft agreement with Mesa Arc.

Not the eighteen million contract.

A new one.

Purchase price:

$6.2 million.

Why lower?

Because Mesa Arc had apparently withdrawn original interest months earlier after learning ownership was disputed.

Daniel found another buyer:

Redstone Recovery Partners.

They wanted the rights for six point two.

Still enough to make Richard desperate.

Then a text between father and son.

Daniel:

If we can’t get Box 214 we have a problem.

Richard:

The amendment dies with them.

Daniel:

Claire has copies.

Richard:

Copies can be challenged.

Daniel:

What about witnesses?

Richard:

Evelyn was drugged. We say incapacity.

Then:

Without Melissa there is no one paying to fight.

That was the core.

They did not believe murdering us automatically gave them everything.

They believed it removed the person most likely to defend Evelyn’s amendment.

Then Daniel:

Sophie heard too much.

My blood went cold.

Richard:

Doesn’t matter now.

I held my daughter tighter.

Then at 11:14, they returned to Silver Creek.

Ethan’s hidden camera near access road captured both trucks.

Daniel carried rope.

Richard carried a shovel.

They went to shaft.

Why?

The missing paper.

They needed bodies.

And the beneficiary schedule.

Ethan had removed the hatch earlier but replaced it loosely.

A second covert camera faced the opening.

Richard lifted.

Daniel shined light.

Nothing on ledge.

He froze.

“Dad.”

Richard leaned.

“What?”

“They’re gone.”

Silence.

Then Daniel screamed:

“They’re fucking gone!”

Richard shoved him.

“Quiet.”

“They’re alive.”

Richard:

“No.”

“Then where?”

Richard searched.

Saw the rope abrasion.

Then:

“Cole.”

They realized Ethan.

At 11:22, Richard called him.

Ethan answered from sheriff’s command post.

Richard:

“Where are you?”

“Town.”

“You went into the shaft.”

“Yeah.”

“Did you see them?”

Pause.

Then Ethan said:

“I saw enough.”

Richard hung up.

Thirty seconds later, Daniel ran for truck.

Deputies moved in.

Richard tried to drive through a blocked road.

He made it sixty yards.

Daniel ran into trees.

Thermal drone found him twenty minutes later lying under a fallen pine.

By midnight, both were in custody.

Alive.

No dramatic shootout.

No escape.

Then Detective Mara Jensen came into my hospital room.

“They’re arrested.”

I expected relief.

Instead I asked:

“Did they find the bank key missing?”

“Yes.”

“And?”

“Daniel told his lawyer a child stole it.”

Sophie whispered from bed:

“I did.”

The detective smiled slightly.

“You may have stolen the most useful piece of paper in Colorado tonight.”

Then her face became serious.

“But Box 214 still has to be opened legally.”

Continue to the next part: Richard and Daniel are arrested when they return to the mine, but the safe deposit box may contain evidence about Evelyn’s final wishes that neither side can yet access.
