Chapter 11 - The Case Against Andrew

The prosecutor did not charge Andrew with breaking my leg.
Margaret did that.
Important.
They did not charge him with causing miscarriage.
No evidence.
They did not claim he intended kill me.
No evidence.
The case stayed narrower.
False imprisonment and unlawful restraint based on dragging me away from exit, preventing departure after severe injury, grabbing ankle during escape.
Assault based on shove and dragging that aggravated injury.
Conspiracy to conceal serious assault through planned false fall story.
Identity fraud tied unauthorized credit line and card.
Unauthorized use of financial identity.
A misdemeanor assault allegation related garage push.
The second older fracture from door incident was introduced as context but not separate intentional fracture count because intent unclear.
The fake parent messages supported control pattern but specific sender attribution mixed.
No overreach.
That made case stronger.
Andrew’s defense:
He panicked.
He followed dominant mother.
He believed waiting until morning was medically acceptable.
He believed financial actions fell within marital authority.
He did not permanently imprison.
He tried to stop injured wife from worsening condition outside.

“You’re not going anywhere. Learn to obey.”
Bad.
Then:
“Tomorrow we tell them she tripped.”
Bad.
Then:
“She quits her job.”
Worse.
Then old texts.
Andrew to Margaret:
If she drives Raleigh, she’s gone.
Margaret:
Then no car.
Andrew:
Already handled battery.

Then loan.
Andrew:
She won’t sign.
Margaret:
Use hers.
Andrew:
I can repay before she notices.
Intent.
Then parents.
Andrew admitted in police interview sending at least three texts pretending me.
Why?
“To create space.”
Without my consent.
Then passport.
He knew held.
Then email forwarding.
Digital log showed rule created from browser session tied his laptop.
Could someone else use? Possibly.
But his laptop, his login.
He denied remembering.
Then fake work email.
Sent from old phone while Andrew physically at Whitmore house according phone location.
Could Margaret have? Yes.
No charge.
Then transition folder.
Mostly Margaret.
But Andrew added lines.
A printed email from him:
If Rebecca quits after bonus, we can manage household without her job. More important she won’t have coworkers filling her head.
Coworkers as threat.
Then custody.
A note:
If divorce after birth, document instability and seek primary if necessary.
Not illegal to plan custody.
But manufactured instability.
Then Andrew’s psychological expert.
He had grown with controlling mother.
Harold passive.
Andrew learned appeasement.
He had difficulty separating own choices from maternal demands.
The psychologist said:
“This may explain susceptibility.”
Prosecutor:
“Does it make him unable to know it is wrong to use someone else’s signature?”
“No.”
“Unable to call ambulance?”
“No.”
“Unable to understand wife has right contact parents?”
“No.”
Then defense asked about remorse.
Expert said genuine emerging.
That could matter sentencing.
Then I prepared.
Dana said:
“Defense may ask why intelligent compliance professional stayed.”
I expected.
“Answer truth.”
“What is truth?”
“You tell.”
I knew.
Because leaving had become series of doors.
Financial.
Emotional.
Pregnancy.
Fear.
Hope.
Shame.
And because Andrew was not cruel every hour.
Sometimes he made coffee.
Held me after nightmares.
Painted nursery sample wall.
Said:
“I’m sorry Mom is difficult.”
Then returned to her side when conflict came.
If he had been terrible every minute, leaving would have been simpler.
But harmful relationships often survive because good moments are real too.

“Do you hate him?”
“No.”
He looked surprised.
“I’m terrified of what he did. Angry. But hate isn’t required.”
“Do you love?”
“Not as husband.”
Maybe some residue.
No need label.
Then Anna grabbed my finger.
She was ten months.
Andrew’s daughter.
My daughter.
Not evidence.
Not symbol.
I promised myself she would never hear me call father monster just to make story easier.
He would have to answer for what he did.
