Chapter 10 - Vivian’s Voice
The recording lasted four minutes and twelve seconds.
I listened once.
That was enough.
Vivian:
“Hi, this is Claire Bennett.”
Trust officer:
“Good afternoon, Ms. Bennett. We received your distribution request.”
Vivian’s voice was softer than usual.
Higher.
She tried to flatten cadence.
Not convincing to me.
But a stranger?

Then verification.

“For additional security, what was the name of the motel where you and your mother stayed during your college move?”

The call ended.
The Pine Lantern motel had been cheap, blue carpet, broken ice machine.
Mom and I stayed three nights when she sold land and moved me closer to school.

That implicated Vivian in restraint direction.

Then next day after Vivian slapped Mom:
Ryan:
You hit her.
Vivian:
She laughed in my face.
Ryan:
Claire will see bruise.
Vivian:

Mom refused? There was no makeup on Mom. Vivian suggested.
Ryan didn't.
Then my early arrival.

She’s here.
Ryan:

Then no more.

Vivian would plead to:
Conspiracy to commit financial fraud.
Criminal impersonation/identity fraud.
Misdemeanor assault against Margaret.
Maybe also attempted theft? Conspiracy includes.
In exchange, prosecution dismissed a more severe vulnerable adult exploitation enhancement due statutory dispute and no completed transfer.
This was grounded.
Vivian resisted assault.
She said she slapped because Margaret mocked.
Still assault.
Eventually.
Then court.
Judge asked:
“Did Claire authorize you to impersonate her?”
“No.”
“Did you know trust funds would go to RVE?”
“Yes.”
“Did you own forty nine percent?”
“Yes.”
“Did you expect personal benefit?”
“Yes.”

Then:
“Did Margaret interfere?”
“She threatened to call Claire.”
“Was that interference or her right?”
Vivian stared.
“Her right.”
Then assault.
“Did you strike Margaret’s face?”
“Yes.”
“Why?”
“I was angry.”
“Did her medical condition matter?”
“I knew arthritis.”
“Did that give you reason to believe she could not defend easily?”
Prosecutor maybe not ask motive. Vivian answered:
“I wasn’t thinking.”
Then sentence.
She was sixty three by then.
No prior criminal record.
No physical injury severe; bruise.
But attempted financial fraud substantial.
Ryan already more central technical actor; Vivian active impersonator.
Twenty months incarceration, maybe shorter than Ryan, followed by three years probation, restitution jointly/individually allocated, no contact Margaret or Claire.

Then her statement.
“I hated that Claire had more than Ryan.”

“I decided secrecy justified our secrecy.”
False equivalence.
Then:
“I am sorry.”
Mom did not speak at sentencing? She did.
She said:
“I came to help with my grandchildren.”

“I was not hired help.”
Then:
“My arthritis makes me slower. It does not make me less adult.”
Then:
“Vivian struck me because I stopped doing what she ordered.”

Then:
“I do not ask for maximum punishment.”
Then:
“I do ask court not to call this family misunderstanding.”
Good.
Then Vivian taken.
Mom cried.
I asked:
“Why?”
“Because I’m glad.”
She looked ashamed.
“You can feel relief.”
Then:
“I also hate prison for an older woman.”

Then twins.
We told simply:
Grandma Vivian is away because she broke serious rules and hurt Grandma Margaret.

Ryan was away too.

Then Claire business.

Then Mom insisted on paying something.
“Rent?”
“No.”
“Groceries?”
“You can buy groceries if you want.”
She did.
Autonomy.
Then one Sunday Ryan called from prison via approved platform.
He asked:
“Can I tell kids I’m sorry?”
Therapist said not burden toddlers with adult guilt. Keep:
“Daddy made a bad choice and is working on better choices.”
He did.
Then he asked me through co parenting app:
“Did Mom plead?”
“Yes.”
Then:
“I’m sorry Margaret had to testify.”
No ask.
