Chapter 11 - Brandon’s Story
Brandon finally spoke during deposition/proffer.
Not to us.
Through counsel.
He admitted some.
Not all.
He said Dad made him responsible for Lily because parents worked.
He resented.
“She was fourteen. Why did I need babysit?”
Fair question.
Then:
“Dad told me she couldn't be trusted after account thing.”
Not fair.
He said first confinement was Dad’s idea.
True.
He said Lily screamed, kicked door, insulted him.
Likely.
He said physical contact happened when she tried to push past.
Sometimes.
But messages showed more.
Then prosecutor confronted with ice-pack text.
Mom thinks I take care of her lol.
Brandon looked down.
“It was a joke.”
“Was she injured when you gave ice?”
“Yes.”
“Did you cause?”
“Sometimes.”
There.
Then photos.
“Why photograph crying?”
“I was frustrated.”
“Why send to friend?”
“I don't know.”
Then:
“Did you ever hit face?”
“No.
Evidence no facial injury.
“Did you ever use weapon?”
“No.”
No.
“Did you ever intentionally break bone?”
“No.”
None.
The case was serious without escalating.
Then motive.
“Did Lily threaten your finances?”
“No.”
“Did she threaten expose source of debt payment?”
“Yes.”
“Did you know eighteen-five came from her account?”
“After March.”
“Did that affect how you treated?”
“I thought she was going to destroy Dad over something he planned to repay.”
Then:
“Why was that your job?”
Silence.
“Because Dad helped me.”
Debt.
Loyalty became enforcement.
Then he blamed Dad:
“He told me to keep her quiet.”
Then prosecutor:
“He told you not to touch her after first bruise.”
Brandon:
“Yes.”
“So later hitting was your choice.”
Silence.
“Yes.”
Important.
Then Brandon’s plea offer:
Guilty to felony child abuse, unlawful restraint, intimidation/coercion.
Recommended effective custody five years with additional suspended term/probation.
He rejected.
Wanted misdemeanor.
Prosecutor refused.
Trial stayed.
Then his friend Caleb Morris testified pretrial.
Brandon once said:
“Dad needs her shut up until he puts money back.”
Caleb told him:
“Dude, don’t touch kid.”
Brandon laughed.
Caleb did not report.
He regretted.
Why not?
“Thought he was exaggerating.”
Another bystander.
No criminal charge absent duty/other factors.
Then Caleb had received photo.
He still did nothing.
At trial maybe jury would hear.
Then Brandon’s attorney showed texts where Dad said “put her in bathroom.”
Defense wanted shift blame.
Prosecutor agreed Dad culpable but not excuse Brandon.
Two adults can be guilty differently.
Then Brandon asked to change plea.
Not because remorse maybe evidence.
He accepted negotiated plea before Lily would need further testimony.
Mom asked Lily opinion.
“I don't want court.”
That mattered to prosecutor, not controlling.
Plea set.
Before hearing, Brandon asked permission to read statement.
Lily declined attending.
I went with Mom.
Brandon stood.
“I hurt my sister.”
First direct.
Then:
“I blamed her because Dad was in trouble and because I thought I owed him for helping me.”
Then:
“I knew she was afraid.”
Then:
“I used ice packs to hide it.”
Then:
“Dad told me to lock her up. He did not tell me to keep hurting her. That was me.”
I looked at Mom.
She cried.
Then sentence reserved for later.
His admission did not restore anything.

Sometimes truth arriving late still matters.
