Chapter 15 - Derek’s Own Screen
The evidence was a screen recording.
Derek had enabled recording on his phone accidentally? Need plausible. Perhaps corporate IT had installed session monitoring on finance devices? Better: bank anti-fraud system captured remote screen session? No. Could be his work computer had screen capture in training software? Too convenient.
Maybe strongest evidence is email he sent to himself titled "If Olivia asks". Let's use digital note.
Derek kept a password manager note.
Title:
OLIVIA STORY.
Created four months before bus stop.
Bullets:
Briarline is her idea.
She wanted consulting on side.
She asked me manage due library rules.
She knows Sterling payments.
She asked to keep off tax return until year end.
If loan questions, she signed.
If transfer questions, she wanted investment overseas.
This is literally false cover story script.
But defense could say notes for hypothetical.
Then bottom:
Need her phone for code.
Best time when she’s mad and distracted.
That is powerful.
Then:
Use spending issue.
My blood ran cold.
He had planned method before specific day.
Prosecutor introduced from his personal cloud, recovered warrant.
Defense objected. Admitted.
Then one line:
She always apologizes first.
I stopped breathing.
Not just financial.
He had studied me.
Then Derek chose testify.
Against counsel perhaps.
He needed explain.
He admitted Briarline existed.
He admitted creating under Olivia’s name.
But claimed verbal permission.
Why forge signature?
“Convenience.”
Why false notary?
“I didn’t think formal document mattered between spouses.”
That was awful.
Why tell employer no conflict?
He said because Olivia not employee and he considered company separate.

Olivia knew conceptually.
Why code?
She had authorized him generally to handle banking.
Why bus stop?
Marriage fight.
Then timeline.
He said he scheduled fight because he wanted confront spending and bank transfer same afternoon.
The line "fight" meant discussion.
Why take phone?
He was angry.
Then used because available.
Why fake text from his phone to hers?
“Trying to repair.”
Thanks for handling bank thing?
He said to create reminder.
Then "Olivia story" note.
He claimed he was preparing responses because she changed mind.
Prosecutor cross.
“Mr. Bennett, if your wife consented, why call it story?”
He said:
“Shorthand.”
Then:
“Why ‘if loan questions, she signed’?”
“Because she did.”
“Digital expert showed signature copied.”
“She gave permission to apply it.”
“Where?”
“Verbal.”
“Notary?”
“I made mistake.”
“Why?”
“Bank wanted paperwork quickly.”
Then:
“Why ‘need her phone for code’?”
“She trusted me.”
“Then why ‘best time when she’s mad and distracted’?”
Silence.
“I didn’t want another argument.”
Then:
“Use spending issue.”
“I knew we had financial disagreement.”
Then:
“She always apologizes first.”
Derek looked toward me.
“I was frustrated.”
Prosecutor continued.
“Your wife’s tendency to apologize was part of bank plan?”
“No.”
Then voicemail.
“Briarline becomes her problem.”
“What does that mean?”
“If business failed, she was owner.”
Exactly.
Even by his story, he intended liability on her.
Then:
“Why was Harbor Nine owned by you and Brenda, not Olivia?”
“Because Brenda and I were exploring investment.”
“Using money from company in Olivia’s name.”
“Yes.”
“Whose loan guaranteed by Olivia.”
“Yes.”
“Whose employer payments you approved.”
“Yes.”
“Without disclosing spouse.”
“Yes.”
Then:
“You were sleeping with Brenda.”
“Yes.”
Then:
“And you expected your wife to carry debt.”
“No.”
“But documents did.”
Silence.
Then accusation draft.
“Why draft letter saying Olivia deceived you if she consented?”
He swallowed.
“Because Brenda panicked.”
“You wrote.”
“Yes.”
“Before bus stop.”
“Yes.”
“Before Olivia discovered.”
“Yes.”
No answer.
Then prosecutor:
“Mr. Bennett, on the day you abandoned Olivia, was the $80 purchase the real reason?”
Derek hesitated.
“It was part.”
“Did you need her phone?”
“Yes.”
That admission.
Then:
“Did you tell her?”
“No.”
“Did you leave her without fare because you knew she would stay put?”
Derek looked at me.
“I thought she’d manage.”
“Did you expect apology?”
“Yes.”
“Why?”
“Because that was our pattern.”
The courtroom became quiet.
He finally said truth.
Control was pattern.
Then defense redirect tried humanize.
Derek believed marriage shared.
He did not set out to hurt Olivia.
He wanted business.
He made bad choices.
Then trial ended.
Jury deliberation.
Eight hours.
No verdict.
Next morning.
Four.
Then note about intent requirement for identity theft.
Judge answered.
Then three p.m.
Verdict.
